McHenry County Suit against Zane Seipler Seeks British Solution

Let’s ferret out how a this lawsuit would theoretically work and progress.

Filing. Haven’t seen any hard evidence reported that anything was filed or who actually said that a suit was imminent.

Then we will have Horwitz motion to dismiss, which will probably be a winner. Unless of course the judge is on the take so I would imagine that Horwitz will be screening every McHenry County judge and finding reasons for removal.

If it were to proceed, discovery would take place. I would suspect there are law enforcement officials that would testify that the use of the stars are worthy of investigation. Judge hears that, case dismissed.

Depositions would be taken. Bianchi would be required to evaluate the evidence and decide if the allegations have merit. He won’t be able to hide behind his attorney client excuse. If he goes under oath and says they have no merit then he could be in grave trouble for his role in the original trial and not just telling Judge Meyer this to begin with.

More depositions of political activist in this county that may be influencing the ins and outs of this situation.

Nygren will be brought in to explain his use of the stars and why he thought it was OK to do what he has done.

Leist and Caldwell will have to justify their expenses and every phone call, email, and communication will be inventoried and examined.

Leist will have to answer questions regarding his new position as the EEO.

These are just some of things I would expect from the “defendants” Seipler and Horwitz.

The other possible action is that the County asks for sanctions from Judge Meyer. That request will be denied. Meyer would not make such a ruling and consider the case frivolous after all that he allowed to go on.

Then there would be the appeals if Seipler were to lose.

It would cost the county a tremendous amount of money to go down this path.

This would also bring into question, who is paying the attorney fees for the “frivolous” appeals Nygren made regarding Seipler’s employment.

Cans of worms are poised to explode.

As best I know, the only time a litigant can recover attorney fees from the losing party is when a contract between the litigants states that fees and costs are recoverable or when statute provides that the prevailing party may collect attorney fees and costs….even then it is within the discretion of the presiding in the case which is the subject matter of the dispute…

    I would not consider the County’s odds of recovering their costs as a very longshot.

  2. I’m smelling “Opportunity” for full “Exposure!!!

    This would be a dream come true law suit for a couple guys I can think of. Opportunity to drag out all the corruption all in one swipe.

    But this time, the players will include those who are not cowards and will climb up Nygren’s ‘back door’ til he can feel them picking the back of his teeth!

    Settle old scores in a very public fashion……..!

    I’m certain Seipler has some very interesting people who have much to tell…?

    A suit such as this will give a whole new meaning to “Cavity Search!”

  3. So- why aren’t we smart about this.

    Caldwell stands to make a good buck on this.

    Nygren spent bucks of money on settling lawsuits that involved bad cops.

    Who tried to do something about bad cops – oh yah – Seipler.

    Maybe someone should have listened!

    Now comes along bad cop (a guy promoted to SGT and a dear one of Nygren), he get indicted on 10 counts of preditory criminal sexual assault of minor under the age of 14 (his kid) and records show that he is still getting his $95,000. a yr.

    Still an employee and getting paid every month.

    Nygren will not stop paying him. Why, I ask?

    Does Pyle have the ability to cause Nygren some problems with knowledge his has??

    Would he be able to verify what Milliman has said about Nygren/

    Complain about bad cops and you will get fired for fudging a WARNING to give some kids a break and you will get fired like Seipler did.

    Saw a sign on some farmland “THINK, it is not illegal YET”.

  5. Since I don’t have a dog in this fight, although some think otherwise, and I’ve always loved people who see black helicopters at night and space ships, please allow me to add to this form of entertainment.

    What IF, and I know you believe there are no IFs involved, nothing comes of all this hub-bub?

    In other words, when and where does all this crap end?

    Whichever side wins this dog-and-pony show, the other side will try and make something of it (the judge was paid off, etc).

    So, for we Taxpayers, who only have a money dog in this fight, when are we done with all this junk from BOTH sides?

  6. Cleaning up the corruption will save a lot in the long run.

    Should have been done a long time ago.

    More lawsuits settlements will have to be paid out.

    Could have been prevented if people did their jobs the way they should.

  7. FYI, assuming there IS real corruption, and not just PERCEIVED corruption, you should be correct.

    MY problem with all this is that whomever loses, the other side will not let it die.

    THAT’s the problem, with what some people PERCEIVE to be true, and what they KNOW to be true, AND can PROVE beyond a reasonable doubt.

    It’s like this Star crap-

    I KNOW, and remember SEEING, MCSO Deputies wearing this Star during the Millimium year 2000.

    Look at some of them NOW, wearing an anniversary ROUND-Style badge.

    I thought that the 2000 year badge was beautiful looking, unlike the current round badge design.

    Apparently some other than just the sheriff thought the same, which is why it is all over their office, and equipment(squads,trailers, motorcycles and snow mobiles, etc).

    Campaign my a_s- just another job of smoke and mirrors…….

  8. There is a process for official stars.

    The 7pt was designed for Nygren as a political emblem.

    The official is 5pt.

    He should not have been mixing them up.

    This is a problem

    Get an investigation and a lot more will be revealed.

    NOT PERCEPTION. Then you get the depositions and the info.

    That is the process needed.

    Some “others” than the sheriff are those that just do whatever he says.

    He has so many of these decals on stuff that they look like my aunt fannie’s fridge with all of her magnets.

    They are very expensive.

    An un necessary expense even if it was done with the official 5 pt.

    This is the kind of crap Blago spent all over the state in an un reasonable way, not using his logo.

    You have been consistent in defending the “cell phone sheriff”.

    Could you be one working for sheriff??

    Can we thank Seipler for creating a situation whereby the sheriff has to actually show up for work??

  11. As I have said above, some PERCEIVE I have a dog in this fight, just as they perceive there is a problem with badges.

    I’ve had my share of time in the courthouse, jury duty once, and the normal number of tickets, and have seen the different badges worn by deputies and the court security officers.

    Again with the ” I thinks but don’t KNOW”.

    Apparently I’m picking a battle of wits fight with unarmed people.

    I’m done.
