The top of the Chicago Tribune story about the dismissal of McHenry County State’s Attorney’s Federal case against the Special Prosecutor who unsuccessfully press criminal charges against him and his staff.
It didn’t make the print edition of the Chicago Tribune today, but the internet edition yesterday carried a story by Robert McCoppin telling of Federal Judge Robert Dow, Jr.’s dismissal of McHenry County State’s Attorney Lou Bianchi’s suit against Henry Tonigan and Thomas McQueen, the Special Prosecutors named by McHenry County then-Associate Judge Gordon Graham, and a couple of Quest investigators.
Dow ruled that McQueen had absolute immunity for his prosecutorial actions. I believe this echos a recent U.S. Supreme Court decision.
As a result of the suit lead Special Prosecutor Henry Tonigan settled with Bianchi before this week’s decision.
Also, as a result of the suit, however, 17,000 documents were released to Bianchi, some of which were used in a contempt of court filing Bianchi attorney Terry Ekl filed against McQueen and the Quest folks.
The Judge gave Bianchi permission to re-file the suit. McCoppin’s article indicates Ekl will next go after McQueen and Quest for their role as investigators.
Those who support Bianchi need to look very closely at this latest action by the McHenry State’s Attorney.
