The Illinois Attorney General notified McHenry County late yesterday afternoon that it is investigating whether the County Board’s Transportation Committee operated within the limitations of the Open Meetings Act at its September 3rd meeting on Randall Road.

The question was first brought up by County Board Nick Provenzano at the Committee meeting.  Assistant State’s Attorneys conferred and decided the notice and agenda met the Act’s requirements.

Later that day your editor filed a question with the AG’s Public Access Division concerning the meeting’s legitimacy on the afternoon of the meeting.

Assistant Attorney General Shari West wrote to Jeffrey Young, “McHenry County Board, Administration Building,” Woodstock.

Requested from McHenry County are the agenda and the “exhibits” have been provided the public.

[None of Exhibit A to the resolution supporting spending on for expansion of Randall Road was available for the committee or the public prior to the meeting.]

The County has seven days to provide a response.

On the Agenda of Tuesday night’s 7 PM meeting is the following:
The vote will be taken after TranSystems makes a “special presentation” of the “Conventional Intersection as the Preferred Alternative for the Randall Road at Algonquin Road Intersection.”

The resolution about which the presentation will explain authorizes triple left turn lanes on Algonquin Road in both directions and double left lanes on Randall Road.  The Algonquin Road turn lanes are shorter in order to allow vehicles to get into Jewel and Caputo’s.

Whether the Randall Road resolution will be voted upon or delayed, given the receipt of the letter you see below, is unknown.
