“Resolution Authorizing a Settlement for the Case of Herron v. McGrath and the County of McHenry 13LA109″

is the information on the agenda of the Law and Justice Committee this morning.

Although it appears to be the largest expenditure being considered–$280,000–its resolution is found at the bottom of the agenda.

What’s it all about?

“The case stems from an accident wherein it is alleged a McHenry County Animal Control Officer driving a County vehicle rear ended plaintiff. Plaintiff, now 27, alleges she sustained injuries and damages to her vehicle.”

The financial implications show that the County is now on the hook for $250,000 for such court cases:

Prior incurred expenses total $18,271.80.

While this amount is not included in the negotiated settlement amount of $280,000, it is credited toward McHenry County’s self Insured retention (SIR) of $250,000 thereby leaving an exposure balance of $231,728.20 to be paid from the McHenry County Tort Fund (OCA180320-4031).

The remaining $48,271.80 will be paid through the County’s insurance carrier, Traveler’s Indemnity Company.

When former Deputy Sheriff Zane Seipler sued the County for wrongful termination, the deductible was $100,000.

County taxpayers now pay the first $250,000.

  1. Wow, who was the person’s attorney?

    Must be pretty good to turn a simple rear-ender into a quarter million dollar payday

  2. I just happened to be the very first car directly facing onward to this accident.

    This was no simple rear ender accident. It was a very violent crash that easily could have killed somebody.

    The car that was ‘rear ended’ was very clearly stopped looking to make a right hand turn.

    The car was stopped because on the right hand side of the road, was some sort of tent that was home to a ‘fair diddley’ type of event.

    The Animal control van was traveling at least the posted speed sign of 55 mph, the van never even applied its brakes!

    It smashed full bore into the back of the automobile that was at a complete stop waiting to make its right hand turn.

    The employees of the Animal Control were obviously not paying any attention at all as to what was taking place directly in front of them.

    THE OUTRAGE!!!!!

  4. Privatize Animal Control!

    The facility they use is too expensive and the property which is in a prime real estate area should be returned to the tax rolls.

    The department of health has grown way too large and getting rid of animal control would be a positive step!
