Could New Law Be Used to Siphon Off Valley Hi Surplus?

The almost break-even Valley Hi Nursing Home now has over $41 million in the bank.

Last year State Rep. Steve Andersson and State Senator Pam Althoff passed House Bill 1500.

The new language can be read below:

(55 ILCS 5/6-1003) (from Ch. 34, par. 6-1003)

Sec. 6-1003. Further appropriations barred; transfers.

After the adoption of the county budget, no further appropriations shall be made at any other time during such fiscal year, except as provided in this Division.

Appropriations in excess of those authorized by the budget in order to meet an immediate emergency may be made at any meeting of the board by a two-thirds vote of all the members constituting such board, the vote to be taken by ayes and nays and entered on the record of the meeting.

After the adoption of the county budget, transfers of appropriations may be made without a vote of the board; however transfers of appropriations affecting personnel and capital may be made at any meeting of the board by a two-thirds vote of all the members constituting such board, the vote to be taken by ayes and nays and entered on the record of the meeting, provided for any type of transfer that the total amount appropriated for the fund is not affected.

I wonder if some attorneys would venture an opinion of whether this new statute could be used to transfer money from the Valley Hi Fund to other places in the budget to be used for capital projects.

  1. Wow Cal, this looks very promising.

    Alot of people keep saying that there was no way to get that
    Money out of there & I just haven’t believed it .

    So let’s see what happens now.

    If this works, that money needs to go back to the taxpayers!

    41 million surplus is ridiculous & needs/has to be dealt with.

    That won’t happen.

    The idea for this legislation was brought up to Sen. Althoff by board members on the Legislative Committee that are working against the taxpayers.

    There is a reason it is against the law to over tax then transfer to other funds/projects–this legislation makes government LESS RESPONSIBLE.

  3. Thank god someone finally passed state-wide legislation to fix a very particular local problem.

    I am sure the down state counties are so totally in our debt for this legislation that means absolutely nothing to them.
