Franks and Bartman Team Up for Literature Distribution

With State Rep. Jack Franks in Philadelphia as a Hillary Clinton Delegate to the Democratic Party’s National Convention, his paid literature distributors are still hard at work.

One forged his name on a piece of literature supporting his campaign for McHenry County Board Chairman in the Lakewood part of my precinct.  In printed letters, it said,

“Sorry I missed you.  Jack”

Another more interesting distribution occurred in Woodstock, where, at no extra cost to himself, Franks had his your person drop both his and a piece for John Bartman, the man who is running to replace Franks in the legislature.

    We need elected officials who are serious about reform and willing to do what it takes to get it done. Step 1 would be to disavow Mike Madigan, none of them will do so.

    Step 2 disavow Crooked Hillary… Franks is a super-delegate.

    Step 3 Disavow the extreme Bernie Sanders acolytes that are running for county board.

    Might also disappoint you to know I voted for John McCain. I have enough first hand experience of Cal Skinner to know that this election is a referendum on his blog and messaging. Look at the candidates he hand picked in the past: Joe Walsh, John O’Neil, Steve Reick, Tonya Franklin
    The McGOP needs to decide if they are going to continue relying on Cal and the loudest voices in the room or to start fielding consensus candidates.

That POS is NOT anyone that could EVER represent anyone of integrity, morals, any kind of values, or love for their fellow man. John Kerry is probably less dangerous than the conniving weasel McCain.     Jack Franks did not oppose all tax increases.

    Jack Franks voted for legislative pension benefit and retiree healthcare benefit hikes that were underfunded and unfunded.

    That hikes taxes.

    That is the worst type of tax hike, because the Illinois state constitution has one sentence regarding pension and retiree healthcare benefit hikes that was approved by voters at a special election on a slew of constitution changes on December 15,1970 that resulted from the 1970 constitutional convention.

    The pension sentence has been interpreted to mean, once a hike is added, it cannot be rescinded as long as that employee is working and once retired as long as they receive their pension.

    Here is the sentence.

    “Membership in any pension or retirement system of the State, any unit of local government or school district, or any agency or instrumentality thereof, shall be an enforceable contractual relationship, the benefits of which shall not be diminished or impaired.”

    That sentence has been interpreted to mean that UNLIMITED benefit hikes are allowed for UNLIMITED value irregardless if pensions are already underfunded and irregardless if the hikes themselves are unfunded or underfunded.

    If you are a taxpayer concerned about taxes of any sort, be they property, income, sales, etc., that is the most important sentence you will read about Illinois government.

    It is extremely important to understand the meaning of the sentence, and what transpired after the sentence was added to the Illinois State Constitution.

    At the time of the pension and retiree healthcare benefit hikes, the pension and retiree healthcare systems themselves were in most cases underfunded.

    One of the major reasons we are in our current predicament is the gross mismanagement by legislators and Governors of the pension and retiree healthcare systems by passing such hikes.

    Pension and retiree healthcare benefit levels should have been frozen until the pension and retiree healthcare systems were fully funded.

    That was not done.

    Bill Zettler in Illinois Pension Scam compares the TRS pension benefit levels in 1970 & 2011.

    The benefits were dramatically hiked.

    Even though TRS has always been underfunded.

    That is a scam.

    The hikes were not explained to voters.

    That is a scam.

    Did the voters advocate for the hikes?

    No.

    Who advocated for the hikes?

    Public sector union lobbyists and employees primarily, and others benefiting from the systems.

    Who are some of the primary funders to Jack Franks political campaigns?

    Unions, both public and private sector.

    Salary hikes should have been held in check until pensions and retiree healthcare was fully funded.

    That was not done.

    Pension and retiree healthcare benefit hikes should have been clearly disclosed to the taxpayer.

    That was not done.

    More money should have gone to pension funding, less to salary and current benefit hikes.

    That was not done.

    Instead pension funding was shorted, money diverted to salary hikes, which hiked the underfunded pensions, a double whammy.

  16. Remember, in the June 6, 2014 edition of the Northwest Herald, reporter Kevin Craver quoted Jack Franks as promising he would not run for County Board Chair in 2016.

    The title of the article was, “Franks Asks County for 2 Advisory Referendums.”

    The article appeared on page 1 and was continued on page 8.

    The quote appeared on page 8.

    To put the promise into context, Mr. Craver wrote:

    “Franks made clear that he is not pushing for County Board changes as an effort to run for the chairman’s seat in two years, following the footsteps of former state senators Chris Lauzen and Dan Cronin, now chairmen of the Kane and DuPage county boards.”

    Flash forward two years, and Jack Franks is running for McHenry County Board Chair in 2016.

    The article said Franks sent a letter to the County board asking them to put two non-binding advisory referendums on the November 4, 2014 ballot.

    In that article Jack Franks promised he would not run for County Board chair in 2016.

    “I can promise you I am not running county chairman in 2016.

    This has nothing to do with me.

    This is about good government.”

    Jack Franks is running for County Board Chair in 2016.

  26. Democrat John Bartman is running against Republican Steve Reick for 63rd District State Representative.

    Democrat Jack Franks is running against Republican Mike Walkup for the inaugural voter elected McHenry County Board Chair position.

    Jack Franks is currently 63rd District State Representative.

    The McHenry County Board Chair has previously been elected by the 24 Board members voting one of their own into the position.

    Jack Franks helped pushed for the change to convert the Board Chair from a Board elected position, to a voter elected position.

    It likely would not have possible for Democrat Jack Franks to be Board Chair unless that conversion took place, as the majority of Board members in recent years have been Republican, and as of right now all McHenry County Board members are Republicans.

  28. A vote for Democrat 63rd District State Representative candidate John Bartman & Democrat McHenry County Board Chair Jack Franks is:

    – a vote against the Governor Bruce Rauner administration and its Turnaround Agenda.

    – a vote to not reign in union power in Illinois government

    – and thus a vote to not control union costs in Illinois government.

    The two Jack Franks two political action committee (PAC) campaign funds that Jack Franks has used (one superseded the other) have been heavily funded by unions, both public and private sector.

    John Bartman is employed as a prevailing wage monitor by an IOUE Local 150 union affiliated organization named IIIFFC (Indiana Illinois Iowa Foundation for Fair Contracting).

    IIIFFC monitors make sure state mandated prevailing wage is paid on union construction projects.

    The Governor’s administration, the Illinois Municipal League (IML), some local units of government, and others wish to scale back the current prevailing wage laws, which have evolved over time.

    Since the total cost of labor (current wages, current benefits, pensions, retiree healthcare) is by far the largest cost of government, this is very important if property and income taxes are to be held to reasonable levels.

    IUOE Local 150 (James M Sweeney, Robert B Paddock) files suit (15 CH 424) in McHenry County Circuit Court alleging the McHenry County Board violated the open meetings act by having a majority of the quorum conducting board business at the Rauner event.

    Just because a majority of a quorum of a public body is present at an event does not mean they violate the open meetings act.

    The violation would occur if the board conducted what would be considered board business according to the state statute.

    The McHenry County Board passes a resolution to rescind the Turnaround Agenda and pay $25,000 for attorney fees to IUOE Local 150 (last report from McHenry County Blog was that no invoice was received from IUOE Local 150 for the attorney fees).

    Rather than spend more taxpayer money fighting the allegation, the Board settled for $25,000 and agreeing to repeal the resolution supporting the Turnaround Agenda.

Also, prevailing wages in Illinois are set by the government, that being the Illinois Department of Labor according to the rules in the Prevailing Wage Act (construction wages) and Illinois Procurement Code (Janitorial Cleaning Services Rates, Window Cleaning Services Rates, Food Services Rates, Security Services Rates, and Printing Rates).

    “The Prevailing Wage Act requires contractors and subcontractors to pay laborers, workers and mechanics employed on PUBLIC WORKS construction projects no less than the general prevailing rate of wages (consisting of hourly cash wages plus fringe benefits) for work of a similar character in the county where the work is performed.”

    “The Illinois Procurement Code requires prevailing wage payments to service employees performing work on STATE contracts.”

    Thus, local government is forced to pay a minimum of state mandated wages, rather than performing their own negotiations.

  35. Here is the McHenry County Board Resolution supporting the Turnaround Agenda (the resolution was rescinded by the Board on April 19, 2016 as the result of a County settlement with IUOE Local 150).

    WHEREAS, Illinois state law creates a “one size fits all” approach to collective bargaining for local units of governments. This approach creates added costs which are ultimately passed on to taxpayers; and

    WHEREAS, voters and local officials should determine what is a subject of bargaining – not the State; and

    WHEREAS, local control of bargaining would allow voters or local governments to determine if certain topics should be excluded from collective bargaining, including contracting, wages, provisions of health insurance, use of employee time, required levels of staffing, procedures and criteria for personal evaluations, academic performance, conduct, and discipline in school; and

    WHEREAS, state law sets thresholds for workers on state and local construction projects increasing costs significantly; and

    WHEREAS, state law has increased utilization of Project Labor Agreements for construction projects; and

    WHEREAS, repealing the Illinois Prevailing Wage Law and the requirements for Project Labor Agreements would allow local governments more control over construction and project costs; and

    WHEREAS, more than 280 unfunded mandates have been imposed in recent years on communities across Illinois, costing those communities billions. Rolling back mandates will create more flexibility in local government budgets; and

    WHEREAS, Illinois’ workers compensation costs are the seventh highest in the nation – and more than double the costs in Indiana; and

    WHEREAS, updating how injuries are apportioned to ensure employers pay for injuries that occur on the job, a clarification regarding the definition of “traveling employees” to ensure a reasonable standard that excludes risks that would impact the general public, and implementation of American Medical Association guidelines when determining impairment would result in major cost savings for local governments; and

    WHEREAS, voters in our community should be allowed to decide via referendum whether or not employees sshould be forced to join a union or pay dues as a condition of employment; and

    WHEREAS, local employment zones will help attract jobs and make our community more attractive for businesses; and

    WHEREAS, local governments face unfunded liabilities that threaten core services and functions of government; state action on pension reform for future work should provide local governments the ability to address pension reform for future work as well.

    NOW, THEREFORE BE IT RESOLVED, by this County Board of McHenry County, Illinois hereby endorses major reforms in state government that will encourage local control, reduce costs on local governments, empower local voters, and increase competitiveness in our community; and

    BE IT FURTHER RESOLVED, that the County Clerk is hereby directed to distribute a certified copy of this Resolution to Governor Rauner; McHenry County State Representatives and Senators; members of the McHenry County Board; the County Administrator; and Department Heads/Elected Officials.

  36. Jack Franks was not a superdelegate (unpledged) delegate to the 2016 Democrat National Convention.

    He was a delegate pledged to Hillary Clinton.
