Jack Franks Gives Himself a Vote on New Committee Appointed for End Run Around Traditional Rules Committee

Observations from a Friend of McHenry County Blog on McHenry County Board Chairman Jack Franks’ latest effort to take power away form the Republican majority on the County Board:

The County Board Chairman’s interpretation of the McHenry County Board Rules, and his ability to organize “ad hoc” committees, is becoming obnoxious.

He deliberately misstates the Rules to justify his ability to ram-rod more changes to the Rules for his personal benefit.

  • Section 3 – 3.7: Internal Support and Facilities Committee: This committee is charged with:
    “Stewardship / liaison for matters pertaining to the… Administration; …”
  • Section 4 – Ad Hoc Committee: “The Chairman of the County Board shall have the power to establish ad hoc committees for special projects. Such committees exist for the life of the project.”

Not only does the update of Board Rules fall under “Administration;” precedence clearly shows this committee, for decades, has been managing this process.

This morning’s “Ad Hoc” Committee Meeting was to once again amend the County Board Rules.

Board Rules do give a chairman the authority to call for a “special project” ad hoc committee.

This means that such committee is only created for the purpose of discussion and action on a “project” not covered by a regular standing committee.

His interpretation and actions fail on this count.

Also of concern is that this person gave himself voting rights in the committee!

An ad hoc committee is a committee of “county board members.”

The county board chairman is not a county board member.

His/her only voting rights, per statute, are for breaking a tie vote of the County Board assembly.

At this Ad Hoc Committee Meeting, in the chairman’s crafted rules changes, he conveniently omitted the fact that the at large elected chair only had the ability to break a tie vote.

Thanks to Member Nowak, at least he had the good sense to amend this section to specifically address the point.

Interesting also was the makeup of this ad hoc committee.

  • District 1 – Bob Nowak
  • District 2 – No one
  • District 3 – Don Kopsel
  • District 4 – No one
  • District 5 – Mike Skala
  • District 6 – Michele Aavang

All are Republicans who have voted with Franks in the past.

These members assured the chair a positive vote for his actions.

But then; that is how politicians with ulterior motives get what they want.

Wake up County Board Members… if you allow all this foolishness to continue… the checks and balances your elected positions are intended to provide the taxpayers of McHenry County are being rendered useless.

  1. Remember the names of people who ran as Republicans and now support the “round mound” little Madigan in McHenry County.

    In particular, Aavang, Skala, Kopsell, Nowak and Steve Reick who had a commercial in which the “round mound” was referred to as a nice guy.

    They must all be primaried!!

    Start with Aavang, Smith, Kopsell, Nowak and Reick this fall when it is time to circulate petitions and then take on Skala, in 2019.

    Unless Bates and Christensen start to show a spine, they too must be primaried in 2019.

    Althoff has stated she will not run again and Tryon is now out of the picture – both have worked ‘across the aisle’ with the “round mound” for too many years.

    We need people with grounded principle to run for office!

    ‘Working across the aisle’ requires one to stray from the Republican platform and adopt ‘Progressive’ princples.

    I think the ad hoc rules need to be updated so all McHenry County residents have a voice at the table.

    County Board rules allow the Chairman to vote in committee, specifically the committee on committees for example.

    Additionally, you misstated that the internal services committee has the ability to oversee rules.

    It’s not in their purview to oversee.

    I’ll expect a retraction by noon – or you can keep lying. It’s up to you.

    Pretty sure she read the rules cover to cover and realized she was wrong, the Internal Services committee doesn’t in fact, oversee rules.

    communication program with residents. Also, stewardship/liaison for matters pertaining to
    construction, remodeling, maintaining and improving County owned facilities. Departments and
    Agencies reporting to this Committee: Facilities Management, Public Building Commission.
    The Internal Support & Facilities Committee attends to suggested changes to Human Resources
    as it pertains to the liaison departments, reviews the Purchasing Ordinance, IT(generally},
    technical maintenance contracts, County liability insurance programs, building security (except
    for the Government Center) and investigates new technology opportunities. It also reviews,
    recommends, monitors and provides oversight for construction projects and capital improvements
    to County owned or leased facilities and properties. This Committee is actively involved in the
    monitoring construction projects and contracts to ensure that projects adhere to authorized budgets,

    timelines and key performance benchmarks and considers change orders as may be required or
    appropriate. In addition, the Internal Support & Facilities Committee reviews options and makes
    recommendations regarding future facility and space needs. The Internal Support & Facilities

    Moderate… I am not sure how you can suggest that the IS&F Cmte. has nothing to do with the board rules.

    In the very first statement it says… “3.5 INTERNAL SUPPORT & FACILITIES COMMITTEE (seven (7) members). Agencies of the: County Administrator; County Board;…”

    As was stated, decades of precedence indicate that every 2 years the then Management Services Cmte. reviews, updates and moves the Rules changes to the full board.

    That isn’t terribly hard to understand unless you are party to the “change” process being shoved down the throats of board members.

    The county board chairman is NOT a county board member and as such has no voting rights except to break a tie vote.

    Mr. Franks’ own state legislation just gave that right in this case.

    A majority of the Board can force him to call a vote.

    If he refuses, a 2/3 majority can vote to suspend the rules and temporarily remove him from the Chair.

    The Vice-Chairman or someone else could then call the vote.

    The simple A, B, C of the county organization: the various county departments are assigned to specific county board committees as the steward/overseers of those departments.

    Committees act as the “liaison” between departments and the county board where final action is concluded.

    Does that help?
