Local 150 “Collective Bargaining Agreement” with Algonquin Township’s Road District – Pages 4-6

Thought readers might be interested in the “Collective Bargaining Agreement” that outgoing Algonquin Township Road Commissioner signed with Local 150 of the International Union of Operating Engineers.

I’ll run a couple of pages a day.

    The ILRB certified the bargaining unit on April 10, 2017.

    It will be interesting to see when the agreement was signed by both parties.

    What is the time frame annually employees can opt out full fees and pay only fair share fees?

    What percentage of full dues is fair share fees?

    What is the purpose of,

    Employees may use accumulated holidays for union business?

    Township Road District employees can accumulate holidays?

    The employer has no say so over the union bulletin board?

    The union can put up vulgar material and the employer can do nothing about it?

    Is this a standard IUOE contract?

    Bob Miller never negotiated a collective bargaining agreement in his life yet did so within a month?

    The public has not been told anything about the negotiations.

    The agreement is not on the Road District website.

  4. Not sure how much negotiating anyone can do with a union contract.

    I believe it would be done by addendum.

    Certainly it was in response to the statements made during the election to protect workers.

  6. Language is commonly negotiated in the agreements, in additions to the addendums which are known b various names such as appendixes / salary schedules / letters of agreement / letters of understanding / memorandums of understanding / memorandums of agreements / side letters / riders, etc.

    Collective bargaining negotiations typically last months and sometimes years.

    Management has a negotiation team.

    Labor has a negotiation team.

    They each submit a proposal.

    They go back and forth.

    The statutes (ILCS) and case law on collective bargaining is voluminous.

    There are all sorts of nuances.

  7. What a lovely gift left for the residents of Algonquin Township.

    While one cannot quantify conspiracy, the rushed nature of this whole thing is scurrilous at best.

    For this to be rushed through at the 11th hour speaks more of the departed Highway Comissioner than the newly anointed.

    For those remotely familiar with the twisted morass of unaccountably and disregard for representative structure that makes up the Illinois Township Code, we know that the Highway Comissioner has no accountability to the board and therefore is his own board in matters such as this. One has to wonder, if the speculation is true that the ‘board’ would have had to approve this ‘contract’; if this entire thing might in fact be illegal.

    Under what circumstances would it be legal for a ‘board’ member to vote on a contract in which a family member is directly involved?

    If the answer is none (and I would expect that some know it all will check in on this) then the contract, which would have been signed off on by the previous Highway Comissioner would in fact, then, be void.

    This departed Highway Commissioner may well become our District 1 County Board rep.

    The people of District 1 have voted both Millers OUT!

    The voting, taxpaying citizens of District 1 will be without representation if Franks appoints a Miller.

    Just the fact that Franks would entertain appointing a Bob Miller to the county board, tells us, either Bob Miller is a Democrat Hog and/or Franks is again, acting like a ‘mean girl’ seeking drama and revenge against the county board.

    What a sad sack!
