Democrats’ Legislation for Retroactive Collection of Higher Income Taxes More Than Irritating

I skimmed the Democrats income tax hike bill last night and am still astonished at their making tax collections retroactive to January 1, 2017.

That information was posted here yesterday, but the audacity demonstrated still has me fuming.

You can see the language below:

Democrats propose an income tax retroactive to the beginning of 2017.

This is not the first time this has been done.

When the Illinois General Assembly re-instated the income tax hike under Jim Edgar’s administration about the third week of July, collections were backdated to July 1st.

    Notice Illinois had no state income tax prior to 1969.

    Note the pension sentence was added to the state constitution on December 15, 1970.

    The result has been pension benefits and retiree healthcare (OPEB) hikes by state legislators and governors, even though in most cases pensions were already underfunded, from 1971 through a few years ago.

    Plus current benefits and salary hikes, even though in most cases pensions were already underfunded, from 1971 to current.

    Retiree healthcare (OPEB) is in general less funded than pensions, and depending on the plan, sometimes entirely unfunded.

    The state income tax provided a source of funding for hiked benefits that are contractual and cannot be diminished or impaired for members in the pension or retirement systems.

    “Membership in any pension or retirement system of the State,

    any unit of local government or school district,

    or any agency or instrumentality thereof,

    shall be an enforceable contractual relationship,

    the benefits of which shall not be diminished or impaired.”

    Retirement system has been interpreted by the Illinois State Supreme Court to mean retiree healthcare, aka OPEB, aka Other Post Employment Benefits.
