Attorney James Kelly has withdraw as the legal representative for the Algonquin Township Road District.

Considering all the ink about Robert Hanlon’s representation of Highway Commissioner Andrew Gasser, some might ask, “Who knew?”

Unbeknownst to me, the Township Supervisor appoints the attorney for the Road District.

Not on matters concerning the conflict with Local 150 of the International Union of Operating Engineers, but on more ordinary matters.

In any event, here’s the resignation letter:


No reason for Kelly’s discontinuation of representation is contained in the letter.

  1. They can appoint with Road Commissioners approval.

    (c) Unless otherwise provided and if approved by the highway commissioner, the township board of trustees may employ and fix the compensation of a separate township attorney who shall represent the highway commissioner. Such compensation shall be paid out of the township road fund.

    Considering there is a conflict, this statute clearly applies from the Highway Code, which governs the Road Commissioner.

    Sec. 6-201.19. Have authority to hire legal counsel to perform legal functions for road districts where performance of such functions by the public official who would otherwise represent the highway commissioner would present a direct or potential conflict of interest.

    Reason being that the trustee’s refused to agree with the Highway Commissioner’s legal budget.

    This was a letter to clarify roles.

    And now it’s clear, he doesn’t represent him, the other shoe is going to drop.
