In the press release from State Rep. Allen Skillicorn on Senate Bill 172, he points out the legislation would allow illegal aliens to serve as student trustees for the University of Illinois.

    My interpretation was been based on

    -The fact that there are already international students in Student Government Association (there’s even one position exclusively for international students) at the U of I system, and the student trustee to the Board of Trustees is also a member of SGA who is elected by the student body (which includes non-citizens). Reconsidering that point, SGA is an internal organization of the college while the University of Illinois Board of Trustees is a part of the state government. I happen to believe SGA shouldn’t allow non-citizens at all, but perhaps I’m so desensitized to Illinois and Illinois colleges having silly policies that my perspective is warped and I just expect the worst now.

    -The fact that government and private organizations often list acceptable forms of identification and one does not have to show all of them but just *a* form listed. However, I missed the word “and” between requirements 2 and 3. That suggests they did intend on making all three of these requirements, not just any one of them.

    -That it would seem odd to require someone possess their own valid driver’s license in order to be a trustee. I can’t think of a single elected official that is required for.

    -Driver’s license, resident for six months, and having a voter card, all prove a common rough equivalence: that you live in Illinois and have for some time. I thought that was the angle they were going for since current law uses the terms “resident/residency” TEN TIMES while the word “citizen” IS NOT MENTIONED ONCE.

    I still stand by the point that they should just explicitly say one has to be a citizen (in addition to being a resident of Illinois) in order to serve as trustee.

    SB 172 in the 101st General Assembly removes that valid Illinois voter registration requirement for U of I student trustees.

    There are three U of I student trustees.

    If SB 172 were to pass into law, the three student trustees would need to prove either:

    1) State of Illinois residency for the past 6 months and an Illinois ID Card or Drivers License.

    Or

    2) State of Illinois residency for the past 6 months and a valid Illinois voter registration.

    Is there a compelling reason for a University of Illinois trustee to be a resident of Illinois?

    For the proper use of funds appropriated by the General Assembly and for the proper administration and government of the University, the Board of Trustees is responsible to the people of Illinois.

    As the governing body of the University, the Board of Trustees exercises jurisdiction in all matters except those for which it has delegated authority to the President of the University, other officers, or agencies of the University.”

    Assistant Majority Leader Iris Y. Martinez (D-Chicago) is continuing her work to expand opportunities for students at the University of Illinois to run for the position of student trustee by amending the university’s residency status requirements.

    ‘Our institutions of higher education should be about promoting leadership opportunities,’ Martinez said.

    ‘Being a student trustee is one good way students can serve and enhance their skills.

    And students who serve in these positions will graduate with an appreciation for the importance of civic engagement.’

    Martinez first introduced similar legislation in 2016 after being contacted by an undocumented student who was unable to run for student trustee, despite the fact that he was enrolled in the university and an Illinois resident.

    The University of Illinois is a proponent of the initiative.”

    The University of Illinois Trustee Act requires students to be residents of Illinois in order to be selected as a student trustee.

    Residency is currently demonstrated by three factors:

    • Evidence of the student’s residence in Illinois for at least the previous six months.

    • A valid Illinois driver’s license or Illinois identification card.

    • Being registered to vote in Illinois.

    But under Martinez’s proposal, a student would have to live in Illinois for six months and either have a driver’s license or ID card, or register to vote in Illinois.

    Gov. Bruce Rauner vetoed the plan in 2016, and the House failed to call it for a vote after it was reintroduced and passed the Senate in 2017.

    Senate Bill 172 passed the Senate Higher Education Committee on Tuesday and now moves to the full Senate for consideration.”

    Obviously there are many ways that U of I students can achieve the Senate Democrat stated objectives without serving as a U of I Student trustee.

    – Become a student member of the University of Illinois Senate

    – Take a leadership position in a class project.

    – Take a leadership position in a club.

    – Participate in the U of I Illinois Leadership Center.

    There are many ways to achieve the State Senate stated objectives without sacrificing the right of taxpayers to be represented by student trustees that are registered voters in the State of Illinois.

    The requirement of student trustees to be a registered voter in Illinois has not prevented the many fiscal problems facing U of I pensions and taxpayers in Illinois, and what difference changing the requirement would make is unknown.

    But the registered voter requirement for U of I student trustees seems reasonable and there does not seem to be a compelling reason to change it.

    Whatever concerns voters in other states and countries have about the governance and operations of the U of I can be addressed in all sorts of ways, without a student trustee representing them on the board.

    This year, new graduate students outnumbered new undergraduate students for the first time since 2007, with 1,648 (51%) and 1,595 (49%), respectively.

    The number of enrolled international students is the second highest the campus has ever seen, with fall 2018’s number of 10,577 topped only by last year’s 10,834.

    Graduate students account for approximately 51.1% (5,405) of this international enrollment, the first time they have outnumbered undergraduate students since 2012.

    Undergraduate students make up 48.9% (5,172) of the international student enrollment, which means both populations are over 5,000 for the third consecutive year.

    Our students represent 116 countries, and increase of 3 from last year, with 87% of students coming from Asia which is consistent with 2017.

At first read of all of this, it looks like Allen Skillicorn is again grandstanding, especially for a possible congressional run in the 14th district next year and looking for an issue that sets him part from declared candidate, State Senator Jim Oberweis, who voted for SB 172 in the senate. “Correcting” is asking the most valid question — if Skillicorn believes the student trustee should be a citizen, he should just say so.

    But Skillicorn is creating a red herring by using the “bogeyman” of a possibility a student trustee being an undocumented immigrant. Last I checked, to receive EITHER an Illinois Driver’s License or an Illinois Identification card, current law is clear you must have a valid Social Security number. An undocumented immigrant will not have this.

    SB 172 is removing the citizenship requirement, proven through voter registration, and opens up the student trustee position to legal resident aliens, or documented immigrants, or legal immigrants (whichever phrase you use to identify a “legal immigrant”). It also removes the requirement that a driver’s license is required, and allows for an Illinois ID card to be used.

    I know, the Temporary Visitor Drivers License program implemented a few years back can give an undocumented immigrant the ability to legally obtain driving privileges. But that law is clear that the Temporary Visitor Drivers License is valid for driving purposes only. It is not valid for identification purposes, including meeting the residency requirement under the proposed SB 172.

    Maybe, given Skillicorn’s congressional aspirations, Cal can reach out to State Senator Jim Oberweis, and discuss why he voted in favor of SB 172, and raise Skillicorn’s assertion that passage will allow an undocumented immigrant to be a student trustee. Since State Senator Sue Rezin, who is also considering running for Congress in the 14th, was one of the 2 votes in the senate against SB 172, maybe Cal can reach out to her and find out the reason(s) she voted against SB 172 (maybe she has a real reason/concern for opposing the legislation).

    Cal, please reach out to those 2 state senators, as I’m sure they would like to get their thoughts on this issue to your McHenry County/14th district residents.
