Private Competition for ICE Detainees Prohibited by Recent Bill Signing

Governor JB Pritzker signed House Bill 2020 on June 21st.

McHenry County Jail

The content, a summary of which is below, ends any threat of competitionto the McHenry County Jail’s housing of illegal imigrants:

Provides that neither the State, nor any unit of local government, any county Sheriff, or any agency, officer, employee, or agent thereof, shall:

(1) enter into an agreement of any kind for the detention of individuals in a detention facility owned, managed, or operated, in whole or in part, by a private entity;

(2) pay, reimburse, subsidize, or defray in any way any costs related to the sale, purchase, construction, development, ownership, management, or operation of a detention facility that is or will be owned, managed, or operated, in whole or in part, by a private entity;

(3) receive per diem, per detainee, or any other payment related to the detention of individuals in a detention facility owned, managed, or operated, in whole or in part, by a private entity; or

(4) otherwise give any financial incentive or benefit to any private entity or person in connection with the sale, purchase, construction, development, ownership, management, or operation of a detention facility that is or will be owned, managed, or operated, in whole or in part, by a private entity. Note that local legislators did not support the legislation, chosing competition over protecting McHenry County government’s parochial interests.

The bill was passed by Democrats.

  1. What’s the hang-up with private entities? Does the State of Illinois contract with private entities to build roads and bridges? Do hundreds or thousands of government bodies contract with “private entities” to provide goods or services?

  2. The problem with for-profit prisons is the same as the problem with government-run prisons.

    The incentives are perverse.

    The goal of people who run prisons is maximization of the number of prisoner-days.

    Is prison staff were compensated for minimizing the amount of recidivism, the way prisons run and their outcomes would be different.

    I recommend reading recent articles on the prison systems in Germany and Norway.

  3. Put the excess rats over at the homes of Acosta, Franks, Yensen, llama-Llavona and Undercrud.

    They can celebrate their law-breaking up front and personal (PS. Acosta’s joint may well be too much stench & squalor for the lawbreakers)

  4. They should be made to do hard labor. At least 8 hour work days.

    They spend all day raping white prisoners and doing drugs.

The Lights for Liberty Vigil to End Human Detention Camps this Friday July 12 from 7:30 to 9 pm at the McHenry County Jail will attract hundreds of participants from the Chicago area and Northern Illinois. This is the main Chicagoland Lights for Liberty event as McHenry County Jail houses ICE detainees, adult immigrants awaiting status hearings, appeals, or deportation orders, who have been rounded up across Northern Illinois. The event is open to the public and one of over 500 events nation-wide. It is organized by a coalition of local organizations and activists who are dedicated to human rights, and the fundamental principle behind democracy that all human beings have a right to life, liberty and dignity and are willing to protect these fundamental rights. There is a groundswell of interest in the event after disclosures of shocking conditions and abuse in holding facilities for children and President Trump’s threat of massive raids, terrifying to many immigrant communities.The event will begin with a rally on the grassy area across from the jail along Seminary Avenue—Route 47—in Woodstock between Ware Road and Russel Court. Speakers will highlight aspects of the abusive system including border detention camps, children and separated families, sexual abuse and violence, the increased hurdles for applying for asylum, and the special dangers faced by LGBTQ persons. At 9 pm the candle light vigil will begin, coordinating with other actions across the country. Participants are urged to bring friends, signs and candles. The event is co-sponsored by Indivisible Illinois, Indivisible Brookfield, Interfaith Community for Detained Immigrants (ICDI), League of United Latin American Citizens (LULAC-IL), McHenry County Democratic Party, McHenry County Democratic Women’s Club, McHenry County National Organization for Women (NOW), McHenry County Progressives, Rape Abuse and Incest National Network (RAINN), Woodstock Pride, and the Tree of Life Unitarian Universalist Congregation Social Justice Team.
