McHenry County Restaurants Are Not Taking Pritzker Purgatory Sitting Down

The following restaurants and bars are suing to invalidate Governor JB Pritzker’s mandate that they stop serving food inside:

Note what seems to be the lack of nationally-owned restaurants.

The suit notes that Governor JB Pritzker has issued nine “disaster” proclamation, which expire 30 days after issuance.

The restaurants and bars are challenging the Governor’s contention that his orders do not expired in 30 days.

The complaint contends that the Illinois Department of Public Health must obtain court permission “to order Plaintiffs’ businesses to be closed and made off limits to the public.”

Noted is the fact that local courts have been open since mid-July and the Illinois Public Health Department has not filed for court permission to do what the Governor has announced.

The lack of due process is brought into play:

Plaintiffs have been denied these due process rights because prior to the closure order

– they were not given written notice, they were not given written notice informing them of the right to court-appointed counsel if indigent,

– they were not given written notice of the reason for closure

– they were not given notice of the time frame to challenge the closure order, and

– they were not given notice of the anticipated duration of the closure.

Besides violating the 30-day limit set in State law for the exercise of emergency powers, the suit argues the Governor has violated the separation of powers by ignoring the Illinois General Assembly.

“The Governor has usurped the Legislature’s power by enacting successive
disaster declarations for the same ‘disaster,’ when the Legislature limited his emergency powers to 30 days,” the suit says.

Due process has been denied as well:

“The Governor has denied Plaintiffs their due process of law by summarily
ordering all bars and restaurants in Region 9 to be closed without abiding by the law and respecting the protections afforded to them by the law.”

John P. Dickson of Crystal Lake is the attorney in the case.

Associate Judge Thomas Meyer has been assigned the case.

He will hear it at 10 AM in Room 201.

    Top Income Tax bracket went from 35% to 39.6%

    Top Income Payroll Tax went from 37.4% to 52.2%

    Capital Gains Tax went from 15 % to 28%

    Dividend Tax went from 15% to 39.6%

    Estate Tax went from 0% to 55%

    These taxes were all passed under the Affordable
    Care Act, otherwise known as Obama Care .

    All these taxes were passed with only Democrat votes.
    Not one Republican voted to do these taxes.
