McHenry County Board of Health Trying to Figure Out What to Do with Reference to the Governor’s Restaurant/Bar Order

To its credit the McHenry County Board of Health figured out a way for people to listen to its members’ deliberations.

At least until Board members voted to go into secret session (which is not mandated by state law) to discuss litigation, perhaps about what internal adjudication would eliminate.

I had a bit of trouble getting connected, but, when I did Health Department of Environmental Health was sharing statistics about complaints since Coronavirus became an issue.

She said there were 385 warnings issued, 138 inspections showed no violations, 32 were given notices of non-compliance and three were given notice “to disperse” whatever that means.

When a Board member asked if there was “need for further action” concerning fining the three restaurants or bars, Adamson’s reply was, “No.”

A member asked who was making the complaints.

The answer included

  • people who have visited the establishments
  • “drive-by” citizens who have seen that “a parking lot is full”
  • “some from other businesses”

Since Saturday when the shutdown of indoor dining was ordered by Governor JB Pritzker, there have been three complaints over the weekend and 12-15 today.

They came from competitors, anonymous tips and one from a local police department who documented the situation and forwarded it to the Health Department, Adamson said.

Previously, the Health Department had been involved in administering rules concerning masks and the size of social gatherings.

Adamson said [now] local police or the sheriff’s office would be called if assistance were needed.

County Board member Mary McCann (the only voice I recognized) asked if the Health Department “would be issuing the tickets.”

Someone observed, “It seems to me that municipalities are putting a lot of burden on us.”

Adamson explained, “We don’t have ticket writing authority. The existing ordinance says we have to provide evidence [but it is not clear what that is].”

A man interjected, “We should be in Executive Session.”

McCann observed that some business that “would really push the limit,” while others are tying [to comply]

“It’s only fair them to know how they are going to be treated.”

A male member stated,

“Some thought should be given as to how valuable it is to really crack the whip.

“The mortality rate is way less than 1%.

“99% of the people recover.”

He questioned whether the Department should be “a real stickler” in enforcing the rules “to smash them into compliance.”

He advised, “That may not be a fabulous plan.

“We are talking about restaurants, but there are all sorts of other locations where the virus [can be spread].”

He questioned whether enforcing the rules will “have any effect.

“[We] may have zero impact.

“I understand that there are techniques [that] can smash this into compliance.

“I don’t know if it is wise.”

Adamson explained that the Department was clear on enforcing the rules on masking and distancing, but unclear on how to enforce the Governor’s order.

Another male Board member “totally” disagreed with the previous man’s viewpoint.

“I think no level of mortality is acceptable in this country.

“As a County Board and Health Department, we should make every effort to prevent every mortality.”

In rebuttal the first man pointed out that none of such restrictions had been imposed to prevent spread of the flu in previous years.

“To derail all [society] to prevent some of these deaths may not be [the best course].

“I think it is absurd to say [any] death is too much.”

He pointed out that we don’t close pools because some people drown, that we don’t ban driving even though there are numerous deaths in traffic accidents.

“These are two different world views.

The second man replied, “Both of those [activities] are reglated.

“That’s what this conversation is all about.”

“How long?” the first man replied.

“One month, two months, a year, two years?

“How long?

“Flattening the curve has already happened.

“It can’t go on like this.”

The man favoring strict enforcement pointed out that some restaurants and bars are “willfully” disobeying the new rules.

A male voice (maybe the same one) said,

“I think this is a debate over whether the rules [make sense].

“The decision has been made by a Health organization that is higher than us.

“Our role is to determine how to best comply with [them].

“Debating the possibility of ignoring, disobeying I think is in appropriate.

“We need to go into Executive Session.

“Maybe out of that will come how this Board, this Health Department will proceed with this situation.”

A woman said she didn’t think comparing the flu was “valid.”

At minute 43 on the recording, the Board shut off what the public could hear.

    It’s good the public was able to listen.

    They should have this option with all of these meetings now.

I admire your tenacity. You seem to hold the most promise for a substitute to stand in my shoes, so I pass the gauntlet to you. Wear it with pride, grasshopper.   6. Nowhere did I see Sheriff Bill Prim brought up.

    If the county sheriff refuses to enforce the government’s ordinance, there is nothing the governor can do to enforce it.

    Meaning, he needs to take his threats and ….

    Time McHenry County leaders man-up and defy Governor Pritzker, peacefully, but using the law to our advantage.

  8. Unfortunately, there is no good solution to cover all residents in McHenry County.

    I feel strongly that a good dose of common sense and reasoning will go a long way in this situation.

    If you are part of a demographic that is adversely impacted by Covid-19, then take the proper precautions, if you are not, then be smart and do your best to protect the people around you.

    My question is “What does done look like?”

    This disease has moved from pandemic to endemic and will be with us for a long time – vaccination will only protect a portion of the population.

    The focus should be on how we get back to normal, not how to enforce mitigation orders that make very little difference in the long run.

    BTW – Can someone please explain or expound on why have a 4 sided tent that is sealed (for outdoor dinning) is any different than sitting in a brick and mortar building to have a meal?

    If they pull the liquor license, charge a cover and let patrons to bring their own alcohol, or just serve it.

    If they pull the health license, operate within the confines of the health code, but go ahead and operate.

    If they “close the gym” make it a “club”.

    OR JUST HOST A “PEACEFUL PROTEST” WITH FOOD AND DRINK, EVERY. DAMN. DAY.

    No matter what you do, OPERATE YOUR BUSINESS.

    There are no “rules” or “orders”.

    We live in a democratic republic and there are limits on government to keep them from tyranny.

    THIS IS WHAT TYRNANNY LOOKS LIKE!

    If engaging with the public is too risky for YOU, then STAY HOME!

    Locally, the County Health Board and County Sheriff should carefully weigh the morality of killing business via stupidity and unconstitutional “orders” – for their own jobs are at stake:

    The law states and precedent upholds that ANY official can be held liable any time the official takes an action depriving any person of his or her rights, privileges or immunities.

    Hey local government goons?

    Would you like to see what happens when local business owners have lost everything and have nothing to do but make sure YOU LOSE YOUR JOB?

    Do you like food stamps?

    Hers’s a quick civics lesson:

    Enforcing an unconstitutional order is a violation of constitutional rights.

    ANYONE that attempts to shut down a business should be reminded of this.

    Violating YOUR constitutional rights equals THEIR LOSS of qualified immunity.

    This is a term that they should understand.

    Law enforcement officers are ONLY entitled to qualified immunity when their actions DO NOT violate a clearly established statutory or constitutional right.

    When their actions DO violate our rights, they LOSE THEIR IMMUNITY and can be sued civily, resulting in harsh consequences. And no – just because “my sergeant told me too…” doesn’t save YOU.

    LOCAL BUSINESS OWNERS – if any official persists that you are in violation of an unconstitutional order, RECORD EVERYTHING and LET THEM TICKET YOU or even ARREST YOU.

    The further they take this, the further they violate the law.

    The further they violate the law, the more case there is for a civil suit against the official.
    The more civil suits brought against officials = less tyranny.

    People learn quick when they’re jobless or in jail.

    (This is also why we elect or appoint JUDGES THAT UNDERSTAND THE CONSTITUTION).

    Here’s a challenge – is your spouse, relative, or friend an employee of local government charged with violating the constitutional rights of local business owners or citizens?

    Would you like for them to keep their cushy healthcare and pension, let alone their SALARY?

    Perhaps ask them to do the research on their own.

    It is their SWORN DUTY to uphold the CONSTITUTION – not the political whims or whomever they work for.

    Do you trust their boss to place your family above their political aspirations? Are they even that smart?

    Think about it.

    ANYONE THAT ACCEPTS A CHECK FROM GOVERNMENT IS LIABLE – the health department, the county, CLPD – ANY municipal employee can be fined, jailed, and/or lose their job for violating the rights of the citizens in their jurisdiction.

    Think I’m kidding??

    LOL.
