Circuit Clerk Does Heavy Lifting on Expungement of 1,877 McHenry County Pot Convictions Completed about Eleven Months Ago

McHenry County ahead of the curve in expunging marijuana convictions.

The Tribune reports, “…on Jan. 1, 2020, Gov. J.B. Pritzker pardoned more than 11,000 people of low-level marijuana convictions.”

McHenry County State’s Attorney Patrick Kenneally is specifically mentioned in the article as asking for 1,900 expungements.

Circuit Court Clerk Kathy Keefe reports,

There were 1,877 misdemeanor cannabis cases (case file dates ranging from 1988 to 2018) which were expunged on January 6, 2020, on the Motion brought by the McHenry County State’s Attorney. 

Below was the criteria used to gather this group of cases:

FINAL list includes:

1)      ADULT cases only;

2)      CONVICTIONS only;

3)      Include ROVOKED Supervisions that became Convictions

4)      DO NOT include any CF cases (even if they were amended down to Misdemeanors); and

5)      That DO NOT have companion cases from the Rights of Crime Victims and Witnesses Act

She continues that the State’s Attorney

gave us the criteria they were looking for and then we had our programmers write a program to pull the list of cases out of our case management system.  

Once we gave them the list, they filed the motion and got the order to expunge them.  

After they are ordered expunged, then it took my office weeks to do the work involved in actually expunging those 1,877 cases and notifying the local police departments and the IL State Police to also expunge their records of the cases.  

It’s quite a process. 

Asked how long the process took, Keefe wrote,

We were probably finished with that paperwork and the notifications by the end of January, or early February at the latest.

    Sad to see the democrats in Georgia embrace legal cannabis, but most Republican POLITICIANS embrace prohibition.

    Poll after poll demonstrate consistent majority support for cannabis reform among all political parties.

    Obviously, politicians opposing freedom are either brainwashed, compromised or otherwise dependent on support from the friends of cannabis prohibition, which there are many.

    Where is there justice when people are imprisoned for growing a God given, seed bearing herb, when alcohol is promoted and unlimited, lethal quantities can be kept in a house where underage people reside?

    Also just read Pres. Trump pardoned a convicted major medicare fraudster because Dershowitz and Kushner pleaded on his behalf.

    Is Trump compromised?

  3. Time for other 1/3 States to legalize.

    Hopefully, we see Federal legalization in 2021.

    There are more important things for our Government officials to focus on.
