Legislature Passes Bill Requiring “Racial Impact” Analysis of Legislation, If Any Member Requests

On page 150 of House Bill 158, a 235 page bill with all sorts of ideas desired by the Black Caucus is a requirement that a “Racial Impact Note” be provided if requested by a State Representative or Senator.

The General Assembly has all sorts of note, the first one of which I believe was the Fiscal Impact Note.

That requires an agency to estimate the cost of passage of the bill in question.

Now, there are lots more now and filing them has become a way to delay a vote on legislation.

The new note would ask for agency evaluations on bills “which has or could have a disparate effect on racial or ethnic minorities.”

The agencies will have to provide “a reliable estimate of the anticipated impact” on them “for which data are available” including

  • assumptions and methodology
  • the composition of the population impacted, including those benefiting and those negatively impacted
  • anything else the agency considers appropriate

Replies must be given within five days, except if the agency requests more time because of the “complexity” of bill…except not after June 15h.

Agencies may reply that they have insufficient information to provide a reliable response, however.

The Illinois Criminal Justice Information Authority is charged with doing the analysis for bills concerning “arrests, convictions, or law enforcement .”

The Department of Corrections gets the job for “corrections, sentencing, or the placement of individuals” in IDOC.

Local government bills analyses shall be directed to the Department of Commerce and Economic Opportunity.

School bills will go to the State Board of Education, junior college bills to the Illinois Community College Board, and university legislation to the Illinois Board of Higher Education.

The proposed law asks for brevity and to “include both the immediate effect and, “if determinable or reasonably foreseeable, the long range effect of the measure on racial and ethnic minorities.”

  1. Found this sentence on page 150 of the Bill:

    “The Director shall endeavor to make the membership of the Partnership diverse and inclusive of the racial,
    ethnic, gender, socio-economic, and geographic diversity of the State.”

    So, “diversity of the State”. Which would include racial diversity “of the State”.

    Exactly what is the diversity of the “Caucus” that is stirring things up? The “racial” diversity? How does it reflect the diversity of “the State”?

    Get your ammo now, if you even can. Hollow point round, just like the police.

    It’s funny in a way, hollow point rounds are forbidden under the Geneva Conventions for military usage.
