State Dems Say McHenry County ICE Floor to Close by End of Year, But Court Battle in Sight

Those opposed to holding illegal aliens in the McHenry County Jail lost their effort to end the contract with the Immigration and Customs Enforcement agency, but succeeded in having their legislative allies pass a bill, signed yesterday by Governor JB Pritzker, mandating such ICE facilities be vacated by New Year’s Day.

Reading the Chicago Sun-Times article, however, revealed that a court fight is in the offiing:

  7. I wonder if either Kankakee, McHenry or Pulaski County signed a contract extension with ICE before this law went into effect?

    I don’t think a state law can void an existing contract with the feds.

    By that logic, then let’s criminalize more things, and more and more! That could drive revenue.

    Before your undies get all up in there, consider the possibility that the ICE contract costs the county more than it benefits.

    Not one proponent of the ICE contract has been able to capably identify what revenue is applied where, or how or WHETHER the ICE contract is a financial benefit.

    They have no idea.

    You have no idea.

    So it’s not the lost revenue that bothers you.

    It’s all the brown people you prefer to see incarcerated.

    “ICE contract” is a McHenry County dog whistle for racists to begin the shit talk about immigrants.

  10. According to the Sun Times article, it states:

    “Pritzker’s office says Illinois is the second state in the nation to require local officials to end partnerships with U.S. Immigration and Customs Enforcement.”

    That would probably be illegal and would violate Pritzker’s Oath of Office which states:

    “I do solemnly swear (affirm) that I will support the
    Constitution of the United States, and the Constitution of
    the State of Illinois, and that I will faithfully discharge
    the duties of the office of Governor to the best of my ability.”

    Pritzker will be in violation of U.S. codes, laws and procedures for immigration and deporting of illegal immigrants (aliens) as defined by ICE, U.S. Immigration and Customs Enforcement

    Per the Enforcement and Removal Operations, ERO, of ICE, it
    “manages all aspects of the immigration enforcement process, including identification and arrest, domestic transportation, detention, bond management, and supervised release, including alternatives to detention. In addition, ERO removes undocumented individuals ordered removed from the U.S. to more than 170 countries around the world”

    Violating the Illinois Oath of Office and authorizing an Illinois State law in contradiction of U.S. Immigration and ICE laws and processes are probably an impeachable offense. When will the Illinois State Legislature start to take action on this matter?
