“Not Guilty” – Angel of Death Case

Word from the courthouse is that the McHenry County State’s Attorney Office was unable to convince Judge Joseph Condon of the guilt of those involved in the Woodstock Nursing Home Angel of Death case.

“Not guilty on all counts,” was the message I got.   “The straw was the state police investigator NOT recording his interview with Penny Whitlock. Kept referring to notes from 2006.”

  1. Much depends on if it was an interview or interrogation. The law which was in effect at that time requires all interrogations of suspects in capital crimes be video recorded. If he Mirandized her, she was in custody, not free to leave, and was clearly a suspect.
