Bianchi Tells of Gauger Case Insurance Settlement

A press release from McHenry County State’s Attorney Lou Bianchi:

McHenry County State’s Attorney’s Office Recovers an Additional $700,000.00 for County

Louis A. Bianchi, McHenry County State’s Attorney, announces that after several years of litigation, the County reached an agreement with

  • Insurance Company of the West and
  • Lloyd’s of London

to settle the dispute over whether either of these insurance companies owed the County money.

Under the terms of the settlement, Insurance Company of the West will pay the County $250,000.00 and Lloyd’s will pay $450,000.

The County previously received over $100,000 from another insurance company which had insured the Assistant State’s Attorneys.

The dispute arose from the prosecution of Gary Gauger, who was convicted by a jury in 1993 of murdering his parents at their farm in Richmond, Illinois.

The Illinois Appellate Court reversed Gauger’s conviction in 1996.

Gauger then filed suit against Sheriff’s deputies, Assistant State’s Attorneys and others, alleging he was falsely arrested and prosecuted.

In that suit, James Sotos, of the Sotos Law Firm, P.C., in Itasca, Illinois, represented the County defendants, and a jury found in favor of all County defendants after a trial in 2009.

The jury’s verdict was upheld on appeal.

The County paid the legal fees of James Sotos, and sought recovery of those fees from Insurance Company of the West and Lloyd’s of London.

The Court action sought to determine what corporate entity, if any, owed McHenry County money for those legal fees.

This settlement resulted in the County recovering a total of $800,000.

  4. I heard that Pack wanted a conviction of Gary Gauger to throw the heat off of a sexual harassment charge occurring at the same time…….and guess who was defending Pack?

    Now why would Harrison want to be around people of type of character?

    Looks like Harrison had bad judgement working for Pack.

  7. well we see what the Pack/Nygren/Harrison Regime days did and Harrison continues to destroy lives for his own benifit (The 2 Prim supporters.

    Now the new news:

    Harrison is stating not accusing but stating that a Republican Committeemen was yelling
    at a Harrison supporter.

    How stupid, as we know, Harrison would have demanded it be front page news like he wanted for a survey vote to be changed in the NWH.

    Harrison would have named the person being yelled at it were true.

    We all know how Harrison wants to attack people.

    Lets get back to the real issues.

    Go on both websites and compare each ones qualifications and backgrounds.

    You will see that Harrison has qualifications as an ATTORNEY and the only thing he has is law enforcement knowledge 25 years ago and for only less than 8 years.

    Prim,however, has an excellent knowledge of police administration,leadership,and experience in the past and present.

    It is clear that Prim is the best candidate for our next Sheriff in McHenry County.

  9. Attacking people is the only way he knows how to win…

    The only thing he manages to accomplish, is making himself look worse, less professional, less credible and clearly lacking in integrity.

    You don’t see Prim attacking people.

    And, we don’t want someone like Harrison taking over the Sheriffs office just so he can use it as a place to continue throwing his temper tantrums.

    Mick Combs should be let go.

    Maybe he can go be a defense attorney in private practice, but I’m tired of him and tired of Bianchi standing by idly.

    It’s a disgrace to victims’ families.

  11. Well, when a guy decides to drop slam dunk felony charges and only stick with misdemeanor charges or when he doesn’t even charge in the first place, you’ve got to wonder about why he’s in that occupation.

    There have been several high profile stories over the last few years where he did just that.
