McHenry County State’s Attorney’s Office Recovers an Additional $700,000.00 for County
Louis A. Bianchi, McHenry County State’s Attorney, announces that after several years of litigation, the County reached an agreement with
- Insurance Company of the West and
- Lloyd’s of London
to settle the dispute over whether either of these insurance companies owed the County money.
Under the terms of the settlement, Insurance Company of the West will pay the County $250,000.00 and Lloyd’s will pay $450,000.
The County previously received over $100,000 from another insurance company which had insured the Assistant State’s Attorneys.
The dispute arose from the prosecution of Gary Gauger, who was convicted by a jury in 1993 of murdering his parents at their farm in Richmond, Illinois.
The Illinois Appellate Court reversed Gauger’s conviction in 1996.
Gauger then filed suit against Sheriff’s deputies, Assistant State’s Attorneys and others, alleging he was falsely arrested and prosecuted.
In that suit, James Sotos, of the Sotos Law Firm, P.C., in Itasca, Illinois, represented the County defendants, and a jury found in favor of all County defendants after a trial in 2009.
The jury’s verdict was upheld on appeal.
The County paid the legal fees of James Sotos, and sought recovery of those fees from Insurance Company of the West and Lloyd’s of London.
The Court action sought to determine what corporate entity, if any, owed McHenry County money for those legal fees.
This settlement resulted in the County recovering a total of $800,000.
