Banker Jack Franks Takes Heat in Johnsburg

A group called “Citizens for Fiscal Fairness” has unleashed a press release aimed at Johnsburg State Bank Chairman and attorney Jack Franks, who just happens to be on the ballot running against Republican Steve Reick on the Tuesday after next.

The bottom text notes that people can send Franks a message on November 4th, Election Day.

(Or, right now, if one is voting early or absentee.)

Don’t expect to read anything about the controversy in the Northwest Herald.

McHenry County Blog broke the story by printing a press release from the Village of Johnsburg (see “Jack Franks’ Johnsburg Bank Stiffs Subdivision“).

A while later, the NWH ran the same story the same day it endorsed Franks for re-election (see “NWH Endorses Jack Franks for State Rep., Name Not Mentioned in Johnsburg Bank Story “). but the NWN story did not mention Jack Franks’ name.

Maybe the paper did not want to run a mixed message that day–favorable in the endorsement and unfavorable in the news story.

In any event, the county’s paper of record now has a second chance to communicate the distain that a Johnsburg subdivision’s residents and it Village President Ed Hettermann seem to have for the eight-term State Representative.

PLEA FROM WHISPERING RIDGE HOMEOWNER’S ASSOCIATION TO THE VILLAGE OF JOHNSBURG

The President of the Whispering Ridge Homeowner’s Association has asked the Village for assistance in compelling the State Bank to complete its infrastructure obligations in the Whispering Ridge subdivision.

He expressed frustration that the association’s attorney, a lawyer at the same firm representing the bank, has declined to press the matter in court on behalf of the homeowners.

Apparently, the State Bank had previously appointed one of its attorneys as the attorney for the homeowner’s association.

State Bank’s attorney and Chairman, Jack Franks, has maintained that the bank is not obligated to provide infrastructure improvements in the development because it did not have a “profit motive” when it took over ownership of the development and therefore the taxpayers of the Village should bear the cost.

Such position has been met with shock and disappointment by the Village Board.

“The Village has a long-term history of doing business with the State Bank and we are shocked with their decision not to honor their obligations in this matter”

said Village President Ed Hettermann.

The Village filed suit in an effort to bring the matter before a jury and in response to which the State Bank has indicated that it will use its best efforts to prevent the matter from being heard by a jury.

The development, consisting of 75 acres with 45 lots, received final plat approval in 2007. Much of the infrastructure was completed at that time, however final paving of the roads along with sidewalk improvements and landscaping still remain incomplete.

Upon taking over as developer, the State Bank sold off 43 of the 45 lots, benefitting from the sale proceeds, yet they refuse to address the outstanding liabilities associated with the development.

“The State Bank’s refusal to complete the improvements is an effort to place the cost burden squarely on the residents of Johnsburg, which is completely unacceptable,”

said Village President Ed Hettermann.

The Village Board’s decision to take legal action was unanimous and came after several attempts by the Village to amicably resolve this matter.

“The Village Board and I have an obligation to protect the interests of our residents and we would be derelict in our duties if after not being able to amicably resolve this matter we did not continue with legal action against the bank”

said Village President Ed Hettermann.

  1. If you complain about our state’s leadership, it’s time to remove those leaders who enrich themselves at the taxpayers expense.

    This slimy politician has been fooling us for 16 years.

    Franks is nothing but a self-serving liberal who has claimed to be “one of us”.

    He despises us.

    Kick this scoundrel out and vote for Reick.

  2. The ‘character’ of voters in McHenry County is absolutely disappointing.

    Just take a look a the County Board and delve into the voting patterns of the people on the board. What did the voters do in the primary? They voted for a pro-development person and get rid of a conservative!

    These same voters claim to support the ag character of our county!!

    Is Reick the perfect candidate?

    No, but who running is?

    He will not support Madigan and will work for the people instead of the unions – I am not referring to union members, I am referring to the union organizations who financially ‘rape’ their members and the public at large.

  4. In answer to ‘voter’, some vote for the guy who has never missed a meal because of support he has received from Wheeler and Althoff.

    Hopefully the NEW management of the McHenry County GOP will work to re-establish the County GOP as a ‘reputable’ group by supporting the GOP platform and not treat it as a joke.

    We need to work on recruiting candidates who will actually support the platform.
