Kelly Liebmann Takes County Board to Task over Jack Franks’ Patronage Hires

Here is what former McHenry County Board member candidate Kelly Liebmann said to the County Board last night:

The inappropriate and improper hiring of the Chairman’s Executive Assistant and
Communications Specialist must be addressed post haste.

The avoidance of communication to the Board and manner of approach regarding county affairs by the Chairman, Administrator and HR Director warrant a review.

As Board Members you could be financially liable.

Illinois Counties Code Article 5, Section 5-1013 states:  (55 ILCS 5/5-1013) (from Ch. 34, par. 5-1013)

Neglect of duty.

If any member of the county board of any county in this State shall willfully neglect to perform any of the duties which are or shall be required of him by law, as a member of the county board, he shall, for every such offense, forfeit the sum of $200, to be recovered in a civil action.

The Fiscal Budget Policy was neglected. R-200210-12-196 was approved authorizing a county wide budget policy on vacant positions.

Three Items referring to the 90 day time limit to filling positions were ignored.

Also breached was the policy stating,

“If the above rules and guidelines are not followed, the position and budget will be automatically eliminated from the personnel roster.”

The Position Reclassification Budget Directive was also ignored.

Also violated in various ways is R-200305-12-113 the Employee Wage and Compensation System which reads, “all employee positions within the County organization are assigned a grade/range/and rate of pay by the Human Resources Department.”

The Salary Administration Policy was bypassed; circumventing the Job Evaluation System and the Job Classification System that were approved by the County Board in R-200802-12-058.

A Position Analysis was not completed.

Position Descriptions were not developed by the Human Resources Department.

Salary Structure policies were not followed. Mid-year New Position Requests were not approved by the Liaison Committee, HR Committee, Finance and Audit Committee and the County Board.

I ask Board Members,

Are you going rectify your neglect of duty and rescind the employment of these two ill-considered hires, or are you going to let the Chairman and Administrator, who are not subject to penalty or liability, further delay action on this matter?

    Jack Franks will consult the Parliamentarian he hired to represent the County Board Chair (which will be paid for with taxpayer dollars), who works for the company his PAC reported contributed $1,000 to the Supporters of Jack D Franks PAC just one day prior to Jack Franks being elected County Board Chair?

    The County Board will consult the county States Attorney?

  6. The Jack Franks hired Parliamentarian is Nick Peppers of Storino Ramello & Durkin which is located in Rosemont.

    Jack Franks is the first county board chair to have hired his own Parliamentarian.

    Past County Board Chairs have used the McHenry County State’s Attorney’s office for Parliamentarian services, whom have not charged the county for Parliamentarian services, over and above what they are already getting paid.

    But for an unexplained reason Jack Franks is using taxpayer dollars to outsource County Board Chair Parliamentarian services to a Cook County campaign contributor.

    Illinois has many laws which are enforced against citizens, and many laws which are not enforced when cavalierly overlooked by public employees.

  9. It appears Kelly Liebmann has done her research and is asking the County Board to adhere to their own rules and regulations.

    Great idea!

    Seems to me the majority of taxpayers and ordinary citizens adhere to the rules and regs of their employers and those who don’t end up employed elsewhere.

    Nothing novel there so why are the McHenry County Board and it’s elected Chairman any different?

    Each Board member AND the Chairman should be held to the highest standard because the public has entrusted them to do their job and to do it within the guidelines and parameters of the rules and regs.

    As a former Corporate Secretary (Liason to an international Board of Directors) and Executive Director for more than 18+ years reporting directly to the global Chairman of a privately held global corporation, it seems this was an end run around the Board of Directors and HR Committee to add staff that was neither approved nor needed in the past.

    And very much a “Let’s take a decision and ask forgiveness after the fact” action.

    I’ve seen it before and if the Board members don’t show some spine and nip this in the bud this Chairman will walk all over them.

    So, elected officials, which will it be?

    Talk talk talk in Board Meetings or do your job to adhere to County Board rules and budgets and hiring practices?

    We the taxpayers (and providers of your salary and benefits!) are waiting and watching. . .

    To the 4 County Board members who are standing strong against this gamesmanship, I applaud you and encourage you to stay the course and continue doing the right thing.

    Has anyone at the County released the particulars of what Jacko’s private Parliamentarian is being paid, or is that going to take a Freedom of Information Act request?

  14. Nope not the same, but that is good advice, especially if Andrew gets carried away and brings in a whole new partronage staff as unqualified as he is.

    Andrew and Jack have been working together on the reducing county levy by 10%, or so I’ve read on Andrews Facebook page.

    Sounds like that is something we should all support.

    Kelly is correct on this issue, and I like her bluntness also.

  19. How can McHenry County citizens initiate action to force County Board members to act to enforce County Code or be subject to $200 fines?

  20. Here is another example of changing job descriptions in Illinois government to accommodate political hires.

    This one involves the Rod Blagojevich administration.
