Five Years for Cocaine and Heroin Intent to Sell Charge

A press release from McHenry County State’s Attorney Patrick Kenneally:

GREGORIO PENA SENTENCED TO 6 YEARS IN THE ILLINOIS DEPARTMENT OF CORRECTIONS

Patrick D. Kenneally, McHenry County State’s Attorney, announced that 33 year-old Gregorio Pena of Harvard, Illinois was sentenced to six years in the Illinois Department of Corrections for the offense of Unlawful Possession with the Intent to Deliver Cocaine 1 < 15 Grams and four years in the Illinois Department of Corrections for the offense of Unlawful Possession with the Intent to Deliver Heroin.

“We are pleased with the sentence and, as part of our broader strategy to combat opioid/heroin use in this County, will continue to seek extended prison terms for those accused of dealing this poison,” said Kenneally

Gregorio Pena was found guilty of both charges after a jury trial on June 29, 2017.

The facts at trial revealed that at approximately 12:15am on November 23, 2016, Harvard Police Law Enforcement made a traffic stop on a vehicle in which Gregorio Pena was the front seat passenger.

Gregorio Pena was arrested for an active arrest warrant.

Before he was arrested, Gregorio Pena was seen reaching down the right side of his seat.

During an inventory search of the vehicle, Harvard Law Enforcement recovered a plastic container that contained multiple baggies of cocaine and heroin where Gregorio Pena was reaching.

The street level value of the cocaine and heroin was approximately $1,000.00 USC.

The case was prosecuted by Assistant State’s Attorney Alexander J. Geocaris and Kyle R. Bruett.

    “In 2006, [Donna] Kelly prosecuted Gregorio Pena and Antonio Figueroa, two members of the Latin King Street Gang, for their involvement beating a former gang member outside of a tavern in Harvard.

    Both men were found guilty and sentenced to the penitentiary.”
