McHENRY POLICE ARREST TWO SUBJECTS FOR DRUG-INDUCED HOMICIDE
John Birk, Chief of Police of the McHenry Police Department, announced today the arrest of two male subjects in connection with a death investigation that occurred in McHenry.
TIMOTHY R. COLBY (age 43, DOB: 04/28/1975), last known address of 1506 W. May Ave., McHenry, Illinois, and CHRISTOPHER L. BIRONG (age 45, DOB: 02/23/1973) of 2113 Willow Brook Dr., #1D, Woodstock, Illinois, were charged on 10/24/2018, by the McHenry Police Department.
Both subjects were taken into custody in McHenry without incident.
On July 10th, 2018, the McHenry Police Department and McHenry Township Fire Protection District responded to rescue call in the 3100 Block of Lincoln Road for an unresponsive adult male victim.
The initial investigation determined the victim had been deceased before the arrival of the first responders.
The victim was identified as Shawn A. Akerman, 43 years old, of McHenry, Illinois.
Autopsy results confirmed that the victim’s death was attributed to the adverse effect of heroin and fentanyl.
The McHenry Police Department’s Criminal Investigation Division, with the cooperation of the McHenry County Sheriff’s Office, McHenry County Coroner’s Office and the McHenry County State’s Attorney’s Office, conducted an extensive investigation into this death.
Probable cause was established to show that both Timothy Colby and Christopher Birong unlawfully delivered the drugs that attributed to the victim’s death.
Timothy R. Colby was charged with
- 3 Counts of DRUG-INDUCED HOMICIDE (Class X Felonies)
- 3 Counts of UNLAWFUL DELIVERY OF A CONTROLLED SUBSTANCE (Class 1 Felonies)
Christopher L. Birong was charged with
- 3 Counts of DRUG-INDUCED HOMICIDE (Class X Felonies)
- 3 Counts of UNLAWFUL DELIVERY OF A CONTROLLED SUBSTANCE (Class 1 Felonies)
