Fight For Freelancers Leads Nationwide Coalition in Amicus Brief

More than 250,000 self-employed Americans in hundreds of professions urge the National Labor Relations Board to respect the choice of independent contractor work


WASHINGTON, D.C., FEBRUARY 10, 2022 — Fight For Freelancers USA, a nonpartisan, grassroots, self-funded, ad hoc group of independent contractors and small-business owners, is leading a nationwide coalition of everyday citizens in urging the National Labor Relations Board (NLRB) to respect the right to choose independent contractor work.

In December, the NLRB requested amicus briefs about the standard it should use to determine independent contractor status going forward.

Such briefs are regularly filed by well-funded entities and dark-money groups.

The voices of real people are often missing altogether.

Last night, Fight For Freelancers filed an amicus brief by, for and with independent contractors whose careers are being threatened and harmed by the push to restrict self-employment nationwide.

The group’s leaders, all professional freelance writers, volunteered their time to write the brief using examples of successful briefs and legal citations. Next, they reached out to fellow independent contractors from long-established and ad hoc groups nationwide to co-sign the brief, which represents more than 250,000 self-employed Americans.

“We want our voices given at least equal weight. The people pushing these policies are deeply misguided individuals who seem hell-bent on misclassifying us as employees, when we are in fact small-business owners.”

The amicus brief filed last night states that the NLRB should not adopt the ABC Test standard that Congress tried, and so far failed, to copy in the Protecting the Right to Organize Act. The same ABC Test decimated independent contractor income and careers as California’s Assembly Bill 5.

The amicus brief further explains that independent contractors comprise one-third of the U.S. workforce; details why more women have been choosing independent contractor work for decades, including during the pandemic; dispels the myth that app-based workers make up a large percentage of these small-business owners; and cites a litany of studies showing that the vast majority of independent contractors want to remain independent.

And, the amicus brief explains how the push to restrict independent contractor work creates an unfair regulatory landscape, favoring paid lobbyists and those with special access to lawmakers.

As McHenry County Blog continues covering the issues of jobs and the economy, federal legislation known as the Protecting the Right to Organize (PRO) Act (H.R. 842/S. 420), particularly its impact to worker classification with freedoms the Left wants to remove from all Americans to choose the way to market their labor with the “ABC test”.

The PRO Act was featured as a centerpiece of the White House’s Labor Task Force report made public this past Monday.

The ABC test was originally developed in the 1930s for factory workers’ classifications.

The modern ABC test is a three-part test, A, B, and C that differentiates W-2 employees from 1099 independent contractors. Under a law with the ABC test, a worker is automatically considered an employee for tax status unless they meet all three of the following criteria.

  • The worker is free from the control and direction of the hiring entity in connection with the performance of the work, both under the contract for the performance of the work and in fact;
  • The worker performs work that is outside the usual course of the hiring entity’s business; and
  • The worker is customarily engaged in an independently established trade, occupation, or business of the same nature as that involved in the work performed.

The b-prong, or 2nd bullet above, is where most 1099 workers run into trouble, and this is how the Left tries to force employers to reclassify their workers from 1099 independent contractors to W-2 employees, who would be eligible, or likely forced into union membership (under the PRO Act if approved, right-to-work laws in 27 states would be nullified).

The Left’s government-knows-better mentality wants all workers to be forced into a union, pay union dues and unions will fund Leftist politicians and causes, including Planned Parenthood.

The ABC test is currently used for tax status in two states: Massachusetts and California. The California AB5 law cited in the press release, effective January 1, 2020, implemented the ABC test for tax status.

Illinois uses the ABC test for workers compensation and unemployment compensation, but NOT for tax status. The “common law”, or “IRS test” is used for tax status in Illinois, which favors workers determining for themselves how to be classified.

The Fight for Freelancers USA amicus brief and the harm it could cause to nearly 59 million workers, has the ABC test at its core.
