  8. Attorney General Candidate, Tom Devore: putting village of Lake in the Hills on notice!

    My friends if you think abuse of power is limited to people like Pritzker, think again. Government actors, usually due to stupidity, abuse authority every day.

    In Lake of the Hills, there is a lady who owns a bakery of some sort and wanted to start having drag shows.

    I’m not interested in getting into that quagmire but some idiot damaged her building because he didn’t like the idea.

    These events brought attention to her small business and low and behold the zoning of her property doesn’t allow for these events.

    The city gave her notice of the violation of the zoning code and told her she couldn’t have events. From a zoning perspective, it wasn’t the type of events but just events.

    After public pressure, the next day, the city says there is an agreement to allow her to have the events.

    Here is the deal.

    Zoning doesn’t work that way.

    If the zoning code doesn’t allow for an activity in a particular district, it is barred absent a variance which requires a public hearing and notice.

    Moreover, a variance is almost never appropriate to authorize a prohibited use in a district.

    What it takes is an amendment to the zoning code authorizing a new use in the whole district which applies to all businesses in the district.

    A city can’t just cut zoning deals to appease one particular business.

    That’s an abuse of discretion called spot zoning and not really that much different technically from an abuse of authority like what the Governor has been doing, but on a much smaller scale.

    Until a city gives notice, has public input, has a meeting or two, etc., it can’t just authorize a business to engage in prohibited uses.

    I’ve been telling you all for years the law always has a process on government action. You just have to educate yourself and quit assuming they can just “do it”

  9. I will absolutely concur that zoning works (and does not work) precisely as described above by Mr. DeVore.

    This sounds like a case of spot zoning at its finest, and would definitely qualify as an abuse of discretion.

    A conscientious local zoning board should always be proactively working to insure uniform application of zoning laws/ordinances in the community.

    On the positive side, this particular issue is not that difficult to correct if the zoning board and/or city council has the backbone to apply the zoning code properly.

  10. G-man, do you have a link to the Tom Devore statement on Lake in the Hills?

    I couldn’t find it on his campaign website, campaign Facebook page or law firm’s website and Google search did not provide link.

    In spite of being unable to verify its authenticity, the content is accurate.

    The Village of Lake in the Hills could not and should not have waived its zoning ordinances without some kind of public action by the Lake in the Hills Village Board.

    The statement is accurate that, “Zoning does not work that way.”

    Here’s what it appears like to me, in my honest opinion:

    Once the ACLU of Illinois attorneys got involved, the Village, property owner(s) and adjoining businesses were coerced into an agreement, paraphrasing, “you’ll agree to this, or else!” all in the name of promoting LGBTQ rights.

    That’s how old style coercion/arm twisting works.

    The elected officials accountable to the Lake in the Hills residents are the six trustees and the president of the Village Board.

    That is where questions about this “agreement” should be referred.

    Hopefully, Cal has FOIAed the agreement through the village clerk in order to see the contents of this agreement including the terms.

    But more important, all politics is local and any Lake in the Hills resident thinking of running for Village Trustee in April’s village elections, the integrity of the Village’s zoning ordinances is a genuine issue to present to voters in the wake of this deal brokered by ACLU lawyers.
