From State Rep. Blaine Wilhour:
‘We will not comply with unconstitutional gun law’
(Springfield, IL) –– The latest assault on the Second Amendment won’t make Illinois communities safer, but it will ensure honest citizens pay the price for crimes for which they have no connection, according to State Representative Blaine Wilhour (R-Beecher City).
House Bill 5471 as amended restricts the purchase and manufacturing of various types of federally legal firearms and it limits magazine capacity to 12 rounds.
Individuals who own a firearm banned by HB 5471 would be grandfathered in, but they would be required to file an affidavit with the Illinois State Police within 180 days after the bill becomes law.
They would be required to provide the firearm’s serial number and they would receive a special endorsement on their FOID card.
Wilhour said the legislation is blatantly unconstitutional and fails to address the underlining problem of gun violence.
“Shredding our Constitution is not the answer,” Wilhour said.
“Illinois already has some of the toughest gun laws in the nation and the violence in too many places in our state is completely out of control.
‘I will contend, as I have often, that if we really wanted to solve the violence problem in this state, we should solve the opportunity problem.
‘Let’s dig in and meaningfully talk about the culture of violence, broken families, hopelessness, addiction that are raging in our communities and leading our young people to violence.
‘Too many communities in this state have never known hope or opportunity.
‘Lawlessness and violence are unfortunate biproducts of the policies being pushed out of this place.
‘These policies have destroyed opportunity for far too many in this state.
‘Nothing in this bill will solve any of the problems it is intended to solve.
‘All it does is give the appearance of ‘doing something’ without actually doing anything but trampling the rights of honest citizens.
‘Criminals who commit crimes with guns in Cook County will continue to go free while law enforcement will be empowered to confiscate firearms from honest gun owners for failing to comply with unconstitutional registry requirements.
‘We will never come close to stopping gun violence as long as we keep rewarding criminals and punishing honest citizens.
‘We will not comply with this legislation because we don’t to.
“Our Constitution protects us.
“The sponsors of this bill may have won a temporary victory today, but they will lose because they cannot get around the rights we have guaranteed in our Constitution.”
House Bill 5471 now moves to the Governor’s desk where it is expected he will sign it.

Springfield, IL – The Illinois House has given final approval to the most expansive gun control legislation in the history of the state, but State Representative Adam Niemerg (R-Dietrich) says in the end the law will accomplish nothing because it is a clear violation of the Constitution.
“This bill passed with thunderous applause from far-left legislators but in the end very little has been accomplished today,” Niemerg said.
“The bill is a clear violation of the Constitution and will not hold up in court.
“If the intention is to cost honest citizens time and money in defending their Constitutional rights, then mission accomplished.
“If the intention is to prevent violence, then what exactly has been accomplished here?
“We were told there was an emergency, and we could not wait to pass this legislation. Instead of passing a bill that preserved our Constitutional rights and addressed violence in our culture at its root cause, the advocates of this bill chose to enact a bill that will not stand up in court.
“The backers of this bill have a lot of explaining to do.
“They have violated their oath of office by passing a bill that is clearly unconstitutional and they have done nothing to prevent future violent attacks.
“All they have accomplished is wasting time and wasting money.”
