Statement from Sheriff Tadelman Regarding House Bill 5471

As your Sheriff, I wanted to give citizens of McHenry County an update on the recent passage of HB 5471, also known as the Protect Illinois Communities Act.

As your duly elected Sheriff my job and my office are sworn, in fact, to protect the citizens of McHenry County.

This is a job and responsibility that I take with the utmost seriousness.

Part of my duties that I accepted upon being sworn into office was to protect the rights provided to all of us in the Constitution.

One of those enumerated rights is the right of the people to keep and bear arms provided under the 2nd Amendment.

The right to keep and bear arms for defense of life, liberty and property is regarded as an inalienable right by the people.

I, among many others, believe that HB 5471 is a clear violation of the 2nd Amendment to the US Constitution.

Therefore, as the custodian of the jail and chief law enforcement official for McHenry County, that neither myself nor my office will be checking to ensure that lawful gun owners register their weapons with the State, nor will we be arresting or housing law abiding individuals that have been charged solely with non-compliance of this Act.

  6. I’m happy that Tadelman did this, but his statement does appear to be a copy and paste, with minor changes, from other sheriffs same statements.

    I can only imagine that a form letter was sent from his sheriffs association to all sheriffs to publish.

    Colatorti was the only constitutional sheriff candidate who ran.

    Tadelman just lost the majority of his base, Democrats, who won’t support him in 4 years.

    That will be interesting………

    Will Keneally come out in support of the constitution too?

  7. How it that the new law is “unconstitutional” when the SCOTUS decision in Heller applied only to handguns, rifles, shotguns and other arms in “common usage” for lawful purposes at the time?

    Further, Bruen solidified that protected arms are common arms regardless of the year/era.

  10. As for his statement, it’s one that the IL Sheriffs Association provided I believe.

    Majority of the 60 other county sheriffs on board with nullification of this illegal law used the same (or similar) one

  13. We need Prosecuting Attorney Kennally office behind this, he’s the one who brings the actual charges to court where the conviction would take place. And Taddleman only protects unincorporated McHenry County towns, not incorporated ones…CL, Cary, Algonquin, LITH etc Police Depts can all still arrest and Kennally can still indict..so what if Taddleman says “cant use the jail” with the SAFE-T Act this will be a cashless bail, no jail charge folks can just go home if they do get arrested. Come on Patrick Kennally, we need to hear from you–you hold the Prosecution key to all towns in this County.

  15. What will he do if the State Police or municipal cops or the IL nat. Guard or ATF or FBI or blah, blah, blah, come acallin’?

    US Secret Service was used in late December to enforce NY state law in Sullivan Co., And CA state law in Imperial Co.
