What about municipal police departments.

Most McHenry County residents don’t live in unincorporated areas.

They live in villages and cities.

While McHenry County Sheriff Robb Tadelman made it quite clear at a meeting of We the People McHenry County that he would deploy officers to enforce trespass laws should a local police department fail to do so, a Sheriff can’t dictate what laws a police office can enforce.

For example, the Lake in the Hills Police already cooperates with the State Police on FOID card retrieval.

Will Second Amendment supporters carry their appeal for non-enforcement beyond the County level?

  1. Isn’t it true that the MCSD has jurisdiction in every square inch of the County?

  2. Sounds like an excellent question or 2 to ask every municipal candidates on the ballot this year, particularly in contested races.

    Whether it’s Woodstock, McHenry or Crystal Lake city council candidates, or village trustee candidates in Algonquin or other villages, the questions need to be asked.

    Of course, contested race would be best like in Algonquin, but even where trustee candidates are uncontested, like Lake in the Hills or Carpentersville, they should be asked, too.

    Voters have it in their power between now and April 4, but voters must use this power, or someone else will.

  3. I think this will primarily be enforced by the state police when they pull someone over and have a reason to search the car.

    Also in Cook County and Chicago it will be an extra charge when someone is arrested for something else.

    No one has the resources to go looking for people who haven’t registered their weapons.

    Anyone who is looking for a cause celeb and tries to challenge the constitutionality of the law will be setting things up for another Dobbs type situation.

    I can’t see the courts saying it’s OK to own these types of weapons.

    The Heller decision was limited to “commonly used” weapons that people have had all along, so the only way to attack this law is to say that these types of weapons fall into that category, which would set off a political firestorm.

    Gun advocates should have learned from the abortion decision that you don’t want the dog to actually catch the car.

  4. Sheriff’s Constitutional powers supersede that of municipal cops no matter what BullshitScientist thinks or believes.

When local PD Cary or Algonquin PD arrest someone, they dont check with nor call the Sherrifs Dept, they call/contact/look up the County Prosecutors Office to ensure they are “charging correctly” especially Felony charges, so this is all on Patrick Kenneally–will he or wont he Prosecute any charges brought forth from the local munincipal coppers?

    Been waiting on word from him or his office…

    The Prosecutors are the ones who hold the keys here–thats great though, the Sherrifs will never bring charges for them to consider.

    Cal, call or write Kenneally’s office for at least a Statement—a Statement on Taddleman stance, as well as his own offices stance.

    Maybe he’s grouping with other County Prosecutors and they’ll al announce something together, who knows.

  6. It’s nice to have so many sheriffs on our side, but the real issue is whether or not the state’s attorneys will pursue charges.

    A number of downstate SA offices have indicated that they won’t.

  7. Honest, if LITH pulls the bullshit card and arrests you for Pritzker 2a stuff, there is nothing Tadelman can do to help you, it goes right to the SA for prosecution.

    We need the SA in each county to pledge that they will not prosecute, then fat boy is effed.

    the Sheriff has jurisdiction in every inch in the county, but doesn’t have the right to snuff charges from locals.

    LITH has nothing else to do but FOID cards and suicide attempts so they WILL be puppets of the state, always have been.

  9. The real issue here, as has been pointed out, is what a county SA will do.

    It may be telling that none of them have weighed in on that as of yet.

    If municipal cops, or even park district or MCCD cops for that matter, want to charge someone, then the ball falls into PK’s court to decide what to do about it.

    So far he hasn’t said anything.

    Do I care if you have a reasonable gun? Nope. You want to own a bazooka, sorry, but there’s absolutely no reason for you to have one.
    Since I’ve been alive, I don’t know of ONE restriction that the NRA has agreed to.
    In my 74 years, gun deaths have continued to rise, by criminals and by people who are not criminals.
    The ONLY way this is going to change is when the cause of the problem comes up with a solution.
    So NRA, what’s YOUR solution? More guns isn’t working.
