DeWitte earns unanimous Senate support for PTELL legislation

As frustrating and burdensome as property taxes are in this state, we must ensure our governmental entities that depend on those revenues to provide important public services that we rely upon are funded at expected levels.

I’m pleased to announce that legislation I am sponsoring that improves local taxing bodies’ ability to properly budget based on property assessment data received unanimous Senate support this week. 

Senate Bill 508 is a technical change to the Property Tax Extension Limitation Law PTELL that will make a big difference for our local taxing districts, like schools, that rely on assessment data to properly budget and plan for issues such as programming and staffing

This measure is not a tax increase; it simply closes a loophole that has created unanticipated revenue reductions for taxing bodies.

  1. It is a tax increase.

    It enables a loophole to PTELL taxpayer protection limits.

    For example, in the case of Pritzker’s 3 year post-dated $300,000+ rebate of property taxes—given in violation of statutory filing requirements and city ordinances requiring vacant or abandoned property be registered and publicly posted–this $300,000 would be added back to the total base amount on which taxation would be increased by 5% or CPI rate.

    Not clear is whether that add-back will accumulate and apply to all future years’ tax increase base amounts.

    Sounds like maybe no big deal?

    One might think that there are a small enough number of corrupt political insiders getting reassessment rebates?

    Think again. This will be an enormous big deal for taxpayers at times when they will be suffering mightily: when power plants, commercial real estate like shopping malls and office buildings, power-producing solar farms and windmills are decommissioned and win massive assessment reductions.

    As taxpayers are burdened, the schools will get paid, along with inflation increases, so those who are compensated by the taxing districts will be protected and rewarded.

    But any incentive for school districts to react with budgetary empathy for economic suffering of their taxed community is removed.

    Does this bill enable taxing bodies to raise levies higher than they could have without this bill, or not?
