Shortage of Signatures Results in Three Supreme Court Candidates Being Bumped from the Ballot

:Although both the Illinois State Board of Elections Hearing Officer and General Counsel recommended otherwise, Board members (4 Republican and 4 Democrat) voted to toss the following candidates for the Illinois Supreme Court off the ballot:

  • Susan F. Hutchinson (R))
  • Mark C. Curran, Jr. (R)
  • Nancy Rodkin Rotering (D)

The Board ruled 757 signatures were required.

  • Hutchison had 702.
  • Curran gathered 670.
  • Rotering turned in 669.

An appeal is expected.

  1. This lacks context.. there is disagreement on what the minimum number of signatures is.

    Hutchinson, Curran, Rotering all argue that because this is a newly formed district, the minimum number is 500 signatures (which actually becomes 334 for this year only, because signature requirements were reduced by 1/3).

    The objectors argue that they can and should use the voters from the counties that make up the new district to determine the minimum signature amount, which is how they get the 757 signatures.

    Also, the board of elections candidate’s guide said that the minimum was 334.

    They explicitly state in that guide that the guide is not a legal and binding opinion, but it is also pretty f’d up.

    The Hutchinson/Curran/Rotering crew have some past case law on their side, so it wouldn’t surprise me if the courts overrule this in appeal.

    But who knows… its a gray area and both sides have solid arguments.
