Commenter “Billy Bob” brings forth this information about a millionaire defendant in West Virginia’s court case in which the deciding vote was cast by a Supreme Court candidate he financed:

“[Democratic Supreme Court winners] Rochford and O’Brien both received substantial backing from gun control groups, which could call their impartiality into question.

“More problematic could be a 2009 US Supreme Court decision in Caperton v. Massey.

“Massey was a West Virginia coal company that was sued and lost at the trial level.

“Before Massey filed an appeal, its CEO donated $3M to the election campaign of Brent Benjamin, a candidate for the WV Supreme Court who eventually won a seat on the Court.

“Benjamin refused to recuse himself when the case came before the Court and was the deciding vote to reverse the judgement against Massey.

“The matter was appealed to the US Supreme Court, and the Court ruled that the size of the contribution created an appearance of bias which violated Caperton’s due process rights.”
