McHenry Road District Seeks Court Order Forcing Township Board to Sign and File Tax Levy

McHenry Township Road Commissoner James Condon has sued

  • to force the Township Board to approve the $3 million levy he presented the Board and
  • to force the Township Clerk to file that $3 million levy with the County Clerk by the December 29th deadline.

The Board approved a levy totaling $2,095,000 at its meeting Thrusday a week ago on a 3-1 vote.

Condon refused to sign that levy document.

The law firm of Lee & Wombacher, LLC, filed the suit on behalf of McHenry Township Highway Commissioner.

  1. Cal, doesn’t the law say that the township board has to rubber stamp the Road Commissioner’s levy?

    The board can mess with the budget numbers but not the levy amount?

    Goofy IL laws!

    The law says the Board can’t touch the budget.

    The tax levy is a whole different matter and that’s why the Board’s approval is required.

    Otherwise the Road Commish could just turn in his levy w/o Bd involvement

  3. Roger the AT board cut Gasser’s budget for legal expenses at least one or two years.

    So yes the board can mess with the budget, but the levy I’m told the board has no control over.

    I’m told a key word in the law is the board “Shall” approve, not “May” approve.

    This just proves how dumb the board is.

    First he’s Clarence Darrow about a rubber stamp.

    But apparently a real judge with a real law degree and real experience with the law put the kibosh on Miller’s Daughter’s firm’s efforts!

    This explains much of what Nob is about- too much time self polishing.

    I guess he’ll rethink having Bob Miller’s daughter’s law firm representing him in the future.
