Judge James Cowlin Retiring, Could Well Be Replaced by Democrat Appointed by Supreme Court

JUDGES WILL TAKE ON NEW CALLS UPON JUDGE COWLIN’S RETIREMENT

In anticipation of the retirement of Circuit Judge James S. Cowlin on January 30, 2024, Chief Judge Michael J. Chmiel has entered an Administrative Order to further address the looming vacancy in the judicial roster of the Twenty-Second Judicial Circuit.

“We continue to be all-hands-on-deck at the Judicial Center,” says Chmiel who entered Administrative Order No. 2023-22 on December 28, 2023, to address the vacancy being created through Cowlin’s retirement.

“This year has posed great administrative challenges starting with the temporary loss of a judgeship early in the year due to a quirk in the law, the passing of a judge, the unanticipated retirement of now two judges, and changes in the law.

“Our team continues to rise to meet these challenges, which is expected of the good people we have who work to meet the ever-evolving needs of McHenry County.”

Associate Judge Jennifer L. Johnson will take on the “Criminal I Misdemeanor Jury Call” in Courtroom 301 in the Criminal Division while also continuing to serve as the primary back up for the judges in the Problem-Solving Court Division.

After helping the Circuit develop new Alternative Dispute Resolution approaches through a relatively short stay in the Civil Division, Associate Judge Mark R. Facchini will take on the “Criminal Misdemeanor Non-Jury Call” in Courtroom 104.

In addition to his administrative duties and recent assignment to Initial Appearance Court, Chmiel will handle the Small Claims and Arbitration cases of the Circuit and continue the work on ADR and initiatives to address Artificial Intelligence in the Circuit.

A vacancy created through the unexpected passing of Judge Michael E. Coppedge on November 13, 2023, is in the process of being filled in March of 2024.

The vacancy being created through Cowlin’s retirement is scheduled to be filled through the General Election in November of 2024, but could be filled sooner through an appointment of the Supreme Court of Illinois.

“We tell ourselves we get what we can handle, and while we continue to leverage technology, we will continue to serve the legal system to the best of our abilities,“ Chmiel explains.

The new assignments are scheduled to take effect February 1, 2024.

In years past, a Republican has held the Supreme Court seat covering McHenry County. That resulted in Republicans being appointed to fill out the term of a retiring judge, which, in turn, gave that appointee a headstart on getting elected.

Now that a Democrat holds the seat, in all probability, a Democrat will be appointed until an election selects a permanent replacement.

    He’s a uniparty fraud who is weak and has a limited intellect.

    He is in power because he cowered to the will of Al Jourdan decades ago.

    Result – the void is filled by the sluge of the democrat party and guys like Cowlin would rather that happen than a strong conservative with principles become judge.

    Weaklings like Cowlin HATE competence and strength – they recoil from political conviction and honor.

  3. Hs family had nothing to do with his first appointment as an associate judge in 2008.

    His father had died two years earlier and retired in the 1990s.

    No family members in any public office.

    He was selected by the circuit judges in the same sort of process going on now to replace Judge Coppedge.

    Then the kicker Thomas appointed him to the circuit bench in one of his better choices.

    So your nepotism claim is baseless.

    As to his ability as a judge, can you be more specific?

    He is a calm, quiet, humble guy, drives a modest car, low profile, and all that translated to the bench into a good demeanor, patient, no ego to handle or cater to.

    Some judges try to be a personality on the bench; that just gets in the way and makes you worry about how to deal with them.

    Give us boring judges who are smart, listen to the evidence, and know the law.

    He ended up on RTA board by the time Judge Cowlin was picked.

    His power to influence judicial selections was long gone.

    Jourdan was long gone as a local political force – he held power up to the mid 90s – in the Republican Party by 2008, when Judge Cowlin was appointed by a vote of the circuit judges.

    Chmiel was a clerk for Bob Thomas and Algonquin Township attorney during the Miller years.

    He and Cortina who was also Algonquin Township attorney were sycophants to Herb Franks IMO.
